Will the proposed use under the circumstances of the particular case be detrimental to the health, <br />safety, or general welfare of persons residing or working in the vicinity? <br />The proposed license will not be detrimental to persons residing and working in the area as <br />the use, as conditioned, will not create any negative or adverse impacts. The sale of <br />alcoholic beverages will only occur inside the premises, which minimizes potential impacts <br />to the surrounding area. <br />C. Will the proposed use adversely affect the present economic stability or future economic <br />development of properties surrounding the area? <br />The 1.67-acre site is situated within a master planned development that is suitable for the <br />proposed hotel project. Numerous retail and restaurant uses are currently found in the <br />surrounding area, with the hotel development identifying this site as a stable, viable location <br />for businesses to exist. <br />D. Will the proposed use comply with the regulations and conditions specified in Chapter 41 for such <br />use? <br />The restaurant use will be in compliance with all applicable provisions of Chapter 41 of the <br />• Santa Ana Municipal Code and all other state laws that govern the sale of alcoholic <br />beverages. The project site is not in full compliance with the regulations of Chapter 41; <br />however, a variance for a reduction in setbacks is currently being processed for this <br />development. <br />E. Will the proposed use adversely affect the General Plan or any specific plan of the City? <br />The proposed project will not adversely affect the General Plan. Restaurant and ancillary <br />uses such as alcoholic beverage control licenses are permitted within the District Center <br />(DC) general plan designation. Additionally, the project, as designed, is in compliance with <br />the regulations identified in the zoning code. <br />4. The Planning Commission approves Site Plan Review No. 00-03, as conditioned. <br />ADOPTED this ~Z- day of Nnvemher , 2000, by the following vote: <br />AYES: Commissioners Mondo, Nalle, Doughty, Verino, and Cribb <br />NOES: Commissioners None <br />ABSENT: Commissioners Solorio and Richardson <br />• ABSTENTIONS: None <br />
