• <br />RESOLUTION NO. 2000-39 <br />Kdo/1 /28/02 <br />A RESOLUTION OF THE PLANNING COMMISSION <br />OF THE CITY OF SANTA ANA APPROVING <br />VARIANCE NO. 00-09 FOR RELIEF FROM THE <br />REQUIRED SETBACK REQUIREMENTS FOR AN <br />OFFICE BUILDING LOCATED AT 4010 WEST <br />CHANDLER AVENUE <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA <br />ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. The Planning Commission held a duly noticed public hearing on October 23, <br />2000, on Variance No. 00-09, for relief from Santa Ana Municipal Code <br />Section 41-475 at 4010 West Chandler Avenue <br />• B. In accordance with the California Environmental Quality Act, the proposed <br />project is exempt from further review. Categorical Exemption Environmental <br />Review No. 00-60 will be filed for this project. <br />C. Santa Ana Municipal Code Section 41-638 authorizes the Planning <br />Commission to grant a variance upon making certain findings. <br />That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location or surroundings, <br />that the strict application of the zoning ordinance is found to deprive <br />the subject property of privileges not otherwise at variance with the <br />intent and purpose of the provisions of this chapter. <br />Due to the need of the road to elevate and cross over the <br />Santa Ana River, access and egress onto Segerstrom Avenue <br />is restricted. Due to this special circumstance, the strict <br />application of the setback requirement would result in a loss of <br />outdoor storage area needed for the operation of the <br />contracting business. The reduced setback will be mitigated <br />through the addition and upgrading of landscaped materials <br />within the setback. <br />2.
