• <br />RESOLUTION NO.00-28 <br />A RESOLUTION OF THE ZONING ADMINISTRATOR <br />OF THE CITY OF SANTA ANA APPROVING <br />CONDITIONAL USE PERMIT NO.00-11 TO ALLOW A <br />TYPE 47 ALCOHOL BEVERAGE CONTROL LICENSE <br />FOR ON-PREMISES CONSUMPTION OF BEER, WIlVE <br />AND DISTII.LED SPIRITS AT THE EMERALD BAY <br />RESTAURANT, LOCATED AT 5015 WEST EDINGER <br />AVENUE, SUITE V <br />WHEREAS, Conditional Use Permit No. 00-11 came before the Zoning Administrator for a <br />public hearing on July 12, 2000, to allow a Type 47 Alcohol Beverage Control License for on- <br />premises consumption of beer, wine and distilled spirits at the Emerald Bay Restaurant, located <br />5015 West Edinger Avenue, Suite V, Santa Ana; and <br />WHEREAS, following said public hearing, the Zoning Administrator determined to <br />approve Conditional Use Permit No. 00-11, subject to conditions. <br />NOW, THEREFORE, BE TT RESOLVED BY THE ZONING ADMINISTRATOR OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br />1. Based upon the evidence submitted at the abovesaid hearing the Zoning Administrator <br />finds and determines as follows: <br />A. Will the proposed use provide a service or facility which will contribute to the general well <br />being of the neighborhood or community? <br />The proposed upgrade to an ABC License at an existing restaurant will provide a <br />service to the community by making available additional alcoholic beverages for <br />ancillary consumption at the restaurant. The ABC license will not negatively affect <br />the surrounding community as conditions of approval have been included to reduce <br />potential negative impacts and avoid the potential of an attractive nuisance being <br />established at this location. <br />B. Will the proposed use under the circumstances of the particular case be detrimental to the <br />health, safety or general welfare of persons residing or working in the vicinity? <br />The proposed ABC license will not be detrimental to persons residing and working <br />in the area as the use, as conditioned, will not create any negative or adverse <br />impacts. The sale of alcoholic beverages will only occur inside the premises, which <br />also minimizes potential impacts to the surrounding area. <br /> <br />1 <br />
