<br /> <br /> i <br /> <br /> I <br /> i <br /> SECOND AMENDMENT TO <br /> AGREEMENT BETWEEN THE CITY OF SANTA ANA <br /> AND INTERVAL HOUSE FOR THE USE OF i <br /> HOMELESSNESS PREVENTION AND <br /> RAPID REHOUSING GRANT FUNDS <br /> i <br /> THIS SECOND AMENDMENT TO AGREEMENT is entered into on the _ day of <br /> 20 , by and between Interval House, a California non-profit corporation <br /> ("Subrecipient") and the City of Santa Ana, a charter city and municipal corporation organized <br /> and existing under the Constitution and laws of the State of California ("City"). <br /> <br /> RECITALS: <br /> A. The parties entered into that certain Agreement Between the City of Santa Ana and Interval <br /> House for Use of Homelessness Prevention and Rapid Rehousing Grant Funds (Program <br /> Year 2009-10), dated , 20(hereinafter "said Agreement") by which <br /> Subrecipient has been providing support to homeless women or those who are at risk for <br /> homelessness under the Homelessness Prevention and Rapid Re-Housing program <br /> ("HPRP"). <br /> <br /> B. On September 7, 2010, said Agreement was amended to transfer funds between programs <br /> and the services were expanded to better meet the needs of the community. <br /> <br /> C. The HPRP program requires, by statute, that grantee's expend 60% of its award funds within <br /> two years of the date that the U.S. Department of Housing and Urban Development ("HUD") <br /> signed the grant agreement. HUD may recapture and reallocate unused HPRP funds if a <br /> grantee cannot meet this requirement. <br /> D. Based upon current expenditure rates and projections as to whether each grantee can meet <br /> this requirement, the parties hereto have agreed to this amendment to increase services and <br /> funding for this Subrecipient. <br /> <br /> WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br /> the terms and conditions of said Agreement, except those amended in this Third Amendment to <br /> Agreement, the parties agree as follows: <br /> <br /> 1. The Scope of Work and Budget that are referenced in the Agreement shall be amended and <br /> I <br /> replaced with the revised Exhibit A attached hereto and incorporated herein. <br /> 2. Section VI, A. "Agreement Amount" shall be increased by $108,000, for a total "Agreement <br /> Amount" not to exceed $ due to the additional services. <br /> 3. The City Manager is authorized to execute future amendments to the Scope of Services, <br /> change in funding amount or milestone dates with regard to HPRP Subrecipient Agreements <br /> that were previously approved under the HPRP Program. <br /> <br /> <br /> EXHIBIT 2 <br /> i <br /> <br /> <br /> 25A-8 <br />
