• • <br />GAS: 7/22/99 <br />RESOLUTION NO. 99-28 <br />A RESOLUTION OF THE PLANNING COMMISSION <br />OF THE CITY OF SANTA ANA APPROVING <br />VARIANCE NO. 99-07, FOR RELIEF FROM <br />CERTAIN PROVISIONS OF THE SIGN CODE <br />RELATED TO OVERALL HEIGHT, LINEAL <br />FOOTAGE AND SIGN AREA OF A MONUMENT <br />SIGN LOCATED AT 4505 WEST FIRST STREET <br />WHEREAS, Santa Ana Municipal Code Section 41-638 provides for <br />the granting of a variance from the provisions of the Santa Ana <br />Municipal Code, upon making certain findings; and <br />WHEREAS, this Commission held a public hearing on July 12, <br />1999, on Variance Application No. 99-07, for relief from the sign <br />code for height, lineal footage and sign area. <br />NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISION OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br />1. Based upon the evidence submitted at the abovesaid <br />hearing this Commission finds and determines as follows: <br />A. That because of special circumstances applicable to the <br />subject property, including size, shape, topography, <br />location or surroundings, the strict application of the <br />zoning ordinance is found to deprive the subject property of <br />privileges not otherwise at variance with the intent and <br />purpose of the provisions of the Municipal Code; <br />The approval to allow the monument sign to exceed the <br />maximum height, lineal footage and sign face area would <br />not jeopardize the intent of the sign code. as <br />conditioned, the site would be limited in the number <br />and types of signs, therefore reducing sign clutter a <br />goal of the sign code. <br />B. That the granting of a variance is necessary for the <br />preservation and enjoyment of one or more substantial <br />property rights; <br />As conditioned, the variance will limit the number of <br />overall signs on the site. Approval of the variance <br />does not prohibit the identification of the business in <br />an aesthetically appealing manner. Allowing a larger <br />monument sign while reducing the number of overall <br />signs on the site help to maintain an attractive gas <br />station site. <br />1 <br />
