• GAS: 7/22/99 RESOLUTION NO. 99-26 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING VARIANCE NO. 99-05, FOR RELIEF FROM CERTAIN PROVISIONS OF THE SIGN CODE RELATED TO OVERALL HEIGHT, LINEAL FOOTAGE AND SIGN AREA OF A MONUMENT SIGN LOCATED AT 401 NORTH GRAND AVENUE WHEREAS, Santa Ana Municipal Code Section 41-638 provides for the granting of a variance from the provisions of the Santa Ana Municipal Code, upon making certain findings; and WHEREAS, this Commission held a public hearing on July 12, 1999, on Variance Application No. 99-05, for relief from the sign code for height, lineal footage and sign area. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISION OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing this Commission finds and determines as follows: A. That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of the Municipal Code; The granting of a variance, as conditioned, will allow the monument sign to exceed sign limits, while limiting any additional signs on-site. The limitations for signage are in harmony with the intent of the sign code to reduce sign clutter. B. That the granting of a variance is necessary for the preservation and enjoyment of one or more substantial property rights; Approval of the monument sign variation, as conditioned, would not prohibit the identification of the business in an aesthetically appealing manner. The conditions of approval help to offset the size of the monument sign by limiting the number of signs. C. That the granting of a variance will not be materially detrimental to the public welfare or injurious to 1
