A. That because of special circumstances applicable to the <br />subject property, including size, shape, topography, location <br />or surroundings, the strict application of the zoning <br />ordinance is found to deprive the subject property of <br />privileges not otherwise at variance with the intent and <br />purpose of the provisions of this chapter. <br />Due to the shape of the parcel, mixture of uses in the <br />area and the buildings location on the rear portion of <br />the property the variances for the proposed signage are <br />the .only means available for effective advertising for <br />this location. Without the variances, signage for <br />virtually any business on the site would be <br />ineffective, depriving the property owner of the use of <br />the property for retail sales. <br />B. The granting of a variance is necessary for the preservation <br />and enjoyment of one or more substantial property rights. <br />The variances are necessary to increase the visibility <br />and advertising for this business as designed. Without <br />effective advertising, the property owner is limited in <br />the uses available for this site. <br /> <br />C. The granting of a variance will not be materially detrimental <br />to the public welfare or injurious to surrounding property. <br />Approving the variances, as conditioned, will ensure <br />success of the proposed retail center by providing the <br />required advertising necessary. The retail center will <br />provide a benefit to the community by eliminating a <br />current vacant and abandoned building, and act as a <br />catalyst for additional development to occur in this <br />area. <br />D. The granting of a variance will not adversely affect the <br />general plan of the city. <br />The variance, as conditioned, will have no adverse <br />affect on the general plan. <br /> <br />2. Variance No. 98-07 is hereby approved, as conditioned in <br />Attachment A, attached hereto and incorporated herein. <br />2 <br />
