RESOLUTION NO. 97-22 <br />A RESOLUTION OF THE PLANNING COMMISSION <br />OF THE CITY OF SANTA ANA APPROVING CON- <br />DITIONAL USE PERMIT NO. 97-17 TO ALLOW <br />24 HOUR DRIVE-THROUGH SERVICE AT A RES- <br />TAURANT LOCATED AT 1011 EA5T SEVENTEENTH <br />STREET <br />~as:77/s/s~ <br />WHEREAS, this Commission held a public hearing on November 10, <br />1997, on Conditional Use Permit Application No. 97-17, to allow a <br />24 hour drive-through service at a McDonald's restaurant to be <br />located at 1011 East Seventeenth Street; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br />1. Based upon the evidence submitted at the abovesaid <br />hearing, this Council finds and determines as follows: <br />A. That the proposed use will provide a service or facility <br />which will contribute to the general well being of the neighborhood <br />or the community. <br />The 24 hour drive-through service at the McDonald's restaurant <br />will contribute to the well being of the community by providing a <br />facility that serves meals between the hours of 12:00 a.m. and 5:00 <br />a.m. The extended hours of the drive-through will also provide <br />additional employment opportunities to the neighborhood and local <br />community. <br />B. That the proposed use will not, under the circumstances <br />of the particular case, be detrimental to the health, safety, or <br />general welfare of persons residing or working in the vicinity. <br />The 24 hour drive-through window is located 200 feet away from <br />the adjacent residential use to mitigate noise impacts to an <br />insignificant level and will not affect those residing in the <br />vicinity. The applicant agrees to provide window lighting in <br />compliance with the City's security ordinance and follow a <br />sweeping/maintenance schedule of the parking lot (See Attachment <br />B). These measures will ensure that the project will not be <br />detrimental to the health, safety, or general welfare of persons <br />residing or working in the vicinity. <br />C. That the proposed use will not adversely affect the <br />present economic stability or future economic development of <br />property in the surrounding area; <br />The 24 hour drive-through window will contribute to the <br />economic viability of the restaurant and contribute to the economic <br />stability and development by providing services and jobs to the <br />
