However the issue was what uses would be allowed the area of the proposed rezoning. Commissioner Oliver further moved to approve Amendment Application No. 96-08. The motion was seconded by Commissioner Doughty. AYES: Brown, Nalle, Oliver, Doughty, Pedroza, and Segura NOES: None ABSENT: Mondo CONDITIONAL USE PERMIT NO. 96-27 (Melanie McCann) Filed by Mr. Akhtar Khan to allow after hour operations at an existing food establishment located at 711 North Bristol Street in the Bristol Street Specific Plan Area (SP-1) and Planned Shopping Center (C4) zoning district. LEGAL NOTICED: Augu et 11, 1996 PUBLIC NOTICED: August 15, 1996 RECOMMENDATION: Approve Conditional Uae Permit No. 96-27 as conditioned and adopt the findings as submitted by staff. Ms. Melanie McCann, Assistant Planner II, a brief description of the project and the basis for staff's recommendation. Commissioner Oliver asked why staff supports the project in an above average crime area. Mr. McCoy responded that the site was well managed and had minimal criminal incidents. Commissioner Pedroza asked if the business is currently operating. Staff responded that it is currently operating 24 hours daily, Madam Chair Brown asked the applicant if he was aware of the conditions of approval and if he was in agreement with all of the conditions. The applicant, Mr. Akhtar Khan, responded that he was aware of and in agreement with all conditions. Commissioner Oliver moved to approve Conditional use Permit No. 96-27. the motion was seconded by Commissioner Segura. Mr. Bill Apple, Assistant Planner II, provided a brief project description and a basis for staff's recommendation and conditions of approval.
