F. CONDITIONAL USE PERMIT NO. 95-36 (Jamie Watanabe) <br />Review of Conditional Use Permit No. 95-36 to allow after hour operations at <br />Pizza Hut located at 2541 South Fairview Avenue. <br />Direct staff to begin revocation proceedings for Conditional Use Permit No. <br />95-32. <br />Mr. Jamie Watanabe, Assistant Planner II, gave an overview of the <br />Conditional Use Permit and conditions not met. Mr. Mike McCoy, Police <br />Department, stated the light upgrades had not been completed. <br />Ms. Ruth Logsdon of Pizza Hut indicated that they had been complying with the <br />conditions and were receiving mixed messages from staff. Trees had been <br />trimmed since the inspection. <br />Commissioner Mondo moved to continue Conditional Use Permit No. 95-36 and and <br />verified with the applicant that he fully understood what was expected of him <br />according to the conditions of approval. The motion was seconded by <br />Commissioner Nalle (no vote took place). After further discussion, <br />Commissioner Segura moved to direct staff to begin revocation proceedings. <br />There was no second for the motion. <br />The Commission reiterated the previous motion of Commissioner Mondo to <br />Continue Conditional Use Permit No. 95-36 to July 8, 1996. <br />AYES: Brown, Nalle, Doughty, Mondo, Pedroza <br />NOES: Segura <br />ABSENT: Oliver <br />G. CONDITIONAL USE PERMIT NO. 95-32 (Larry Yenglin) <br />Review of Conditional Use Permit No. 95-32 to allow after hour operations at <br />Tacos Serrano located at 415 North Grand Avenue. <br />RECOMMENDATION: <br />Mr. Yenglin provided an overview of the outstanding condition for the pay <br />phones to be removed. <br />Mr. Matt Rogers representing Tacos Serrano spoke in favor of the applicant. <br />He indicated that the phones are on a lease basis and cannot be readily <br />removed and the conditions of approval went against the lease. <br />Mr. Gary Sheatz, Deputy City Attorney, indicated to Mr. Rogers the legality <br />of exercising the Conditional Use Permit versus breaking the lease. <br />Commissioner Doughty mentioned that she would like to look for alternatives. <br />Mr. McCoy mentioned that although its an enforcement issue, he suggested a <br />shut off timer at late night hours. <br />Commissioner Mondo moved to direct staff to begin revocation proceedings for <br />Conditional Use Permit No. 95-36. The motion was seconded by Commissioner <br />Brown (no vote took place). <br />After further discussion, Commissioner Nalle presented an alternative motion <br />to continue for Conditional Use Permit No. 95-36 to July 8, 1996. The motion <br />was seconded by Commissioner Pedroza. <br />AYES: Brown, Nalle, Doughty, Mondo, Pedroza and Segura <br />NOES: None <br />ABSENT: Oliver <br />H. ZONING ORDINANCE AMENDMENT NO. 96-OS (Charles View) <br />Filed by the City of Santa Ana to allow the development of care homes subject <br />to a Conditional Use Permit in Specific Development 19 (Historic French <br />Park). <br />' RECOMMENDATION: <br />Recommend that the City Council approve Zoning Ordinance Amendment No. 96-OS <br />for Specific Development 19. <br />Mr. Charles View, Senior Planner, provided a brief overview of the staff <br />report to allow care homes by conditional use permit in the French Park area. <br />Commissioner Doughty moved to approve Zoning Ordinance Amendment No. 96-05. <br />The motion was seconded by Commissioner Mondo. <br />PIANNINO COMT9ISSION MII4UfFS 2 JUNE 24, 1996 <br />
