APPEAL OF THE PLANNING MANAGER'S DECISION NO. 97-04 <br />Filed by RSCR California, Inc. to appeal the Planning Manager's decision not to permit an exist door <br />from the front bedroom of a single family residence located at 2034 North Olive Street in the Single- <br />Family Residential (Rl) zoning district. <br />RECOMMENDATION: <br />' Deny Appeal of the Planning Manager's Decision No. 97-04. <br />Ms. Melanie McCann, Assistant Planner II, provided an overview of the staff report and <br />recommendation. In addition, Ms. McCann informed the Commission and the public that the use of <br />the caze facility was not an issue, but the location of the exit door at the residential home was the <br />only matter being considered. <br />Mr. Michael Cutchshaw, applicant, provided the history of the care facility and provided an overview <br />of why it was important to the applicant to have the exit door. <br />The following persons spoke in favor of the applicant's request: <br />Mark Antenucci <br />Marsha Siegel <br />Larry Crander <br />The following persons spoke in favor of staffs recommendation: <br />James Broeske <br />Betty Moss <br />Dick Freeman <br />Jim Balay <br />' Terry Balay <br />Hedy Hansen <br />James Gartner <br />The Commission stressed to the public members that the Planning Commission did not have the <br />authority to deny the care facility use; the City could only impose conditions relating to the aesthetic <br />character of the neighborhood. <br />After further discussion, Mr. Adams informed the Commission that the League of California Cities <br />would be looking at possible alternative legislation addressing care facilities. <br />MOTION: Deny Appeal of the Planning Manager's Decision No. 97-04. <br />PLANNING COMMISSION MINGTES L SEPTEMBER 22, 1997 <br />
