COUNCIL CHAMBERS <br />COUNCIL CHAMBERS <br />ROLL CALL <br />PLEDGE OF ALLEGIANCE TO THE FLAG <br />PROCEDURAL RULES <br />7:00 p.m. <br />CONDITIONAL USE PERMIT NO. 95-03 (Vince Fregoso) <br />~J <br />Filed by the City of Santa Ana to conduct a review of the conditional use permit and to modify the <br />conditions of approval for the Main Ranch Market located at 1303 North Main Street in the Specific <br />Development 3 (SP3) zoning district. <br />LEGALLY NOTICED: August 15, 1997 <br />PUBLICLY NOTICED: August 14, 1997 <br />RECOMMENDATION: <br />Adopt a resolution modifying the conditions of approval for Conditional Use Permit No. 95-03. <br />Mr. Vince Fregoso presented the staff report, discussed problems associated with single beer/wine <br />can sales, and the staff recommendation. <br />Sgt. B. Foeller, Police Department, indicated that he was not opposed to single can sales however, <br />he believed that additional single can sales would lead to additional problems in the area. In addition, <br />he reiterated that there was a county probation office, parole office, YWCA, legal offices, and <br />governmental agencies in close proximity to the Main Ranch Market. <br />Commissioners Oliver and Hanna asked Sgt. Foeller if there were any problems when the Trader Toe <br />store operated at the location. <br /> <br />Sgt. Foeller indicated that there had been transient and trash related problems during the Trader Joe's <br />operation. <br />Mr. Mehdi Zadeh, applicant indicated that he wished to sale single can sales to accommodate his <br />customers. He believed that the protest to the market was due to Debbie McEwen, a close neighbor <br />to the market. In addition, Mr. Zadeh alleged prejudice against him from public members and <br />requested the Commission grant his request. <br />Mr. Michael York, Attorney, indicated that there was a lack of evidence with the correlation of large <br />single can sales and the size of beer cans to crime. <br />The following public members spoke in opposition to the sale of single cans of beer and/or wine: <br />Debbie McEwen <br />Jeanette Martin <br />David Gaeta <br />Diann Marsh <br />Zelenne Cardenas <br />Commissioner Mondo expressed concern regarding the alleged racism, the photos submitted related <br />to trash, single can sales of beer and wine, and the outdoor bulletin board. <br />MOTION: Modify the conditiazs of approval with an additional condition for all exterior bulletin <br />boards be removed or relocated to the interior of the building. <br /> <br />MOTION: Mondo <br />Victor Villaneva <br />Teresa Ibarra <br />Barry Jensen <br />Victoria Betancourt <br />SECOND: MacDowell <br />AYES: Oliver, Mondo, Doughty, Verino, Hanna, and MacDowell <br />NOES: None <br />ABSENT: Nalle <br />2.
