VARIANCE NO. 98-05 <br />7:00 p.m. <br />Filed by Mr. Phillip Martin to allow an amendment to the variance for the Huong Tich <br />Temple in order to allow a reduction in the landscaping in the front and side yard <br />setbacks located at 4821 West Fifth Street in the Single-Family (R1) zoning district. <br />PUBLISHED IN THE REGISTER: April 28, 2000 <br />PUBLICLY NOTICED: April 27, 2000 <br />(Continued by the Planning Commission May 8, 2000 to May 22, 20001 <br />RECOMMENDATION: <br /> <br />Adopt a resolution denying the request to amend Variance No. 98-05. <br />Ms. Lynnette Perry, Associate Planner, presented the staff report and provided an <br />overview of the issues related to the amendment request. <br />Chairman Mondo opened the public hearing. <br />The following speakers provided comments in support of the amendment: <br />Mr. Bhikkhu Sunnyata Sakya <br />Mr. Philip Martin <br />Kirk MacArthur <br />Chairman Mondo closed the public hearing. <br />The Commission requested clarification regarding the amendment request and <br />discussed issues related to the approved landscaping, the present landscaping, and <br />the acceptance of a good-faith bond. <br />C <br />Motion to deny the amendment to Variance No. <br />post a good-faith bond far 58,000 during <br />landscaping per the approved p/an. <br />MOTION: Doughty <br />98-05 and direct the applicant to <br />the process of constructing the <br />SECONDED: Richardson <br />Substitute motion to deny the amendment to Variance No. 98-05; direct staff to <br />prepare a resolution approving the requested landscape setback on Rosita Street and <br />the requested landscape setback on the west property line; direct the applicant to <br />post agood-faith bond in the amount of 58,000 and staff issue a 120 day <br />temporary certificate of occupancy a//owing the applicant to modify the landscaping <br />to match the approved plans. <br />3 <br />
