E. APPEAL OF THE PLANNING MANAGER'S DECISION NO.00-04 <br />Filed by Opera Pacific to allow the use of a portion of an industrial building in order to permit combined <br />rehearsals, opera orchestra, chorus, and cast four times a yeaz for four consecutive weeks located at 600 <br />West Warner Avenue in the Light Industrial (Ml) zoning district. <br />RECOMMENDATION: <br />I. Receive and file the Categorical Exemption for Environmental Review No. 00-45. <br />2. Adopt a resolution denying Appeal of the Planning Manager's Decision No. 00-04. <br />Mr. Bob St. Paul, Associate Planner, provided a sumtnary of the issues and staff recommendation. <br />Mr. Martin Hubbard, representing the applicant, provided an overview of the operations of the Opera <br />Pacific. <br />Commissioner Solorio inquired as to the Opera Pacific working with the local schools or with children. <br />Mr. Martin responded that the company currently had 200 performances at schools and that they could <br />intended to continue this partnership. <br />Commissioner Nalle inquired as to the applicant applying for a parking vaziance. Mr. Hubbard responded <br />that applying for a variance would presume that there would be a pazking problem at the site and he <br />reiterated that he did not foresee any parking problems with the production company. In addition, he stated <br />that the additional time to apply for a variance and the time it would take to go through the discretionary <br />process they would forfeit their deposit for the purchase of the building. <br />After further discussions regarding operations of the Opera Pacific, there was a motion to overturn the <br />Planning Manager's Decision. <br />Motion to approve Appeal of the Planning Manager's Decision No. 00-04 and directing the applicant to <br />' apply for a parking variance with the occupancy approval indicating that no performances are allowed <br />and no sublease of the rehearsal space to other users was permitted. <br />MOTION: Nalle SECOND: Doughty <br />No vote took place. <br />Mr. Rubin, representing the applicant, spoke in favor of the applicant's request and stressed to the <br />Commission that it was necessary to get an approval action by the Commission. He further assured the <br />Commission that there would be no performances at the location, therefore it did fall under the usual <br />categories of churches or theater uses as described in the Industrial (Ml) zoning district. <br />Substitute motion to approve Appeal of the Planning Manager' Decision No. 00-04 with the condition <br />that there was to be no assembly use at the location and no sublease of the rehearsal space to other users <br />was permitted. <br />MOTION: Cribb SECONDED: Doughty <br />AYES: Mondo ,Nape, Doughty, and Cribb <br />NOES: None <br />ABSENT: Verino and Richardson <br />ABSTENTION: None <br />E. Discussion of Housing Element (General Plan Amendment No. 00-O1). <br />Ms. Melanie McCann, Associate Planner, provided an overview of the proposed Housing Element, goals <br />and policy framework of the Element. <br />Ms. Pat Whitiker, Community Development Agency, provided an overview of the Draft Consolidated Plan. <br />The Commission and staff further discussed the Regional Housing Needs Assessment and the assessed <br />housing needs for the City. <br />Commissioner Solorio requested staff provide all REHNA information to the Commission so it can be <br />reviewed prior to taking an action on the Housing Element. <br />
