CONDITIONAL USE PERMIT N0.99-13 (Lynnette Perry) <br />Filed by Mr. Tim Ortiz to modify the conditions of approval for the conditional use permit for the La Rioja <br />mazket located at 2725 North Bristol Street in the Community Commercial (Cl) zoning district. <br />(Continued by the Planning Commission December 13, 1999 to January 10, 1999) <br />PUBLISHED IN THE REGISTER: December 3, 1999 <br />PUBLICLY NOTICED: December 3, 1999 <br />RECOMMENDATION: <br />Receive and file the Categorical Exemption for Environmental Review No. 99-24. <br />2. Adopt a resolution denying the request for modifications to the conditions of approval for Conditional <br />Use Permit No. 99-13. <br />Ms. Lynnette Perry, Associate Planner, presented an overview of the applicant's request to reconsider two of <br />the approved conditions of approval for Conditional Use Permit No. 99-13. <br />Mr. Tim Ortiz informed the Commission of his request to modify the conditions of approval related to the <br />' security guard and the sell of single cans and bottles of alcohol. <br />Mr. Kenneth Adams, Planning Manager, informed the Commission that Planning staff had met with Police <br />staff and staff was comfortable with the Commission modifying the security guazd requirement, however staff <br />was strongly opposed to allowing the sale of single cans and bottles at the market and recommended denial of <br />the request. <br />Commissioner Solorio agreed with staff s recommendation regarding removing the security guard requirement <br />and requested that staff identify the existing alcohol beverage control licenses in the area. Ms. Yolanda Pena <br />informed the Commission of three other establishments which sell alcoholic beverages. <br />Several of the Commissioners made comments regarding the litter problem surrounding the store and the <br />center in general. Ms. Pena informed the Commission that she would refer the issue to Code Enforcement <br />personnel. <br />Commissioner Mondo reminded the applicant that condition number three did not allow any exterior <br />advertisement relating to the availability of alcoholic beverages. He noted the existence of a lazge beer <br />advertisement sign over the entry door and requested that the applicant take steps to remove the banner. <br />Commissioner Solorio appealed to his colleagues for consistency in the application of the law and commented <br />that although he supported removing the security guard requirement, he was uncomfortable with the fact that <br />the previously permitted locations could sell single cans. <br />Motion to adopt a resolution approving the request to modify the Police Department condition of approval <br />number nine removing the requirement to have a security guard and denying the request to modification of <br />Police Department condition of approval number 12. <br />MOTION: Mondo SECONDED: Cribb <br />AYES: Verino, Mondo, Nalle, Doughty, Solorio, Cribb, and Richardson <br />OPPOSED: None <br />ABSENT: Nalle <br />ABSTAINED: None <br />
