APPEAL OF THE ZONING ADMINISTRATOR'S ACTION NO. 99-02 <br />Filed by Mr. Tim Ortiz to allow a Type 20 Alcohol Beverage Control License in order to sell beer and wine <br />for off-premise consumption at La Rioja Ranch Market located at 2725 North Bristol Street in the <br />Community Commercial (C1) zoning district. <br />LEGALLY NOTICED: June 21, 1999 <br />PUBLICLY NOTICED: June 23, 1999 <br />RECOMMENDATION: <br />1. Adopt a resolution denying Appeal of the Zoning Administrator's Action No. 99-02. <br />' 2. Adopt a resolution denying Conditional Use Permit No. 99-13. <br />Ms. Lynnette Perry, Associate Planner, presented an overview of the project and staff recommendation. <br />Mr. Tim Ortiz, applicant, presented an overview of the operations of the mazket; indicated that at the time <br />he purchased the market the ordinance had not been passed requiring a conditional use permit for markets <br />under 20,000 square feet; and requested approval of the request. <br />Commissioner Solorio asked if the previous markets at the location had alcohol beverage control licenses. <br />Mr. Adams stated that the two previous mazkets had alcohol licenses. <br />The following members of the public spoke in opposition to the project and expressed concern regarding <br />having another entity in the City to purchase alcohol: <br />Priscilla Sanders <br />Mazia Chinas <br />Raquel Gonzales <br />Jose Castillo <br />M. Pilar Viveros <br />The following member of the public spoke in support of the request: <br />' Juan Vallejo <br />Glen Stroud <br />Motion to: 1) adopt a resolution approving Conditional Use Permit No. 99-13 as conditioned; and 2) direct <br />staff to prepare a Public Convenience and Necessity letter. <br />MOTION: Doughty SECONDED: Nalle <br />AYES: Mondo, Nalle, Doughty, Solorio, Cribb, Richazdson <br />NOES: None <br />ABSENT: Verino <br />ABSTAINED: None <br />9.
