Receive and file the Categorical Exemption for Environmental Review No. 99-26. <br />B. CONDITIONAL USE PERMIT NO. 99-14 <br />Filed by Morgan Corporation to allow the construction of two group homes for the developmentally disabled <br />on a vacant pazcel of land located at 435-437 South Birch Street in Specific Development 40 zoning district. <br />LEGALLY NOTICED: May 30, 1999 <br />PUBLICLY NOTICED: June 7, 1999 <br />RECOMMENDATION: <br />1. Adopt a resolution approving Conditional Use Permit No. 99-14 as conditioned. <br />2. Receive and file the Categorical Exemption for Environmental Review No. 99-27. <br />Mr. Vince Fregoso, Senior Planner, presented the staff reports for Zoning Ordinance Amendment No. 99- <br />05, Conditional Use Permit No. 99-11, and Conditional Use Permit No. 99-14 and staff recommendations. <br />He informed the Commission that the zoning ordinance amendment was necessary to allow group homes in <br />the azea and the request for conditional use permits were necessary for the specific group home requests. <br />Mr. David Silva, representing R. Morgan, provided an overview of the operations of the group homes, <br />descriptions of the group homes, and described the individuals that would be utilizing the homes. <br />Mr. Efrain Olivares, Architect, provided an overview of the structure. <br />The following members spoke in support of the project: <br />Roy Mincer <br />Ginnelle Hardy <br />Polly Musch <br />Rhys Burchill <br />Betty Warner <br />Commissioner Mondo stated that he would like the conditions of approval to define developmentally <br />disabled, per the State definition, to ensure that there is no confusion in the future and in case the facility <br />had to be re-used by another applicant. <br />Ms. Carol Berg, Community Development Agency, indicated that staff was developing a Disposition and <br />Development Agreement indicating that the property would be used only for same use, by another applicant; <br />that the document would be fully prepared once funding sources were confirmed. <br />Ms. Ginelle Hazdy, local resident, requested that she be allowed to review the landscaping plan for the <br />project, especially Birch Street. <br />Motion to recommend that the City Cauncil approve Zoning Ordinance Amendment No. 99-OS and that <br />the City Council approve and certify the Mitigated Negative Declaration for Environmental Review No. <br />99-66. <br />MOTION: Mondo SECONDED: Cribb <br />AYES: Verino, Mondo, Nalle, Solorio, Cribb, Richardson <br />NOES: None <br />ABSENT: None <br />ABSTAINED: Doughty <br />' Motion to adopt a resolution approving Conditional Use Permit No. 99-11 with additional conditions of <br />approval defining developmentally disabled, per State definition and prohibiting any front yard fencing. <br />MOTION: Mondo <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAINED: <br />SECONDED: Cribb <br />Verino, Mondo, Nalle, Solorio, Cribb, Richardson <br />None <br />None <br />Doughty <br />planning Commiaaion Minulca 6 June 14, 1999 <br />
