A- 2009 - 206 -01 <br />AGREEMENT TO TEMPORARILY EXTEND <br />`LI _ TAXI LICENSE AGREEMENT <br />THIS AGREEMENT, made and entered into this 16'b day of December, 2010, by and between A White and <br />Yellow Cab Company (hereinafter "Licensee ") and the City of Santa Ana, a charter city and municipal corporation <br />duly organized and existing under the Constitution and laws of the State of California (`City"), collectively referred to <br />herein as "the Parties ". <br />RECITALS <br />3 A. The Parties entered into that certain agreement entitled "Site License Agreement between the City of Santa <br />Ana and A White and Yellow Cab Company" dated December 19, 2005, hereinafter referred to as "said Agreement ", <br />to license commercial space at The Santa Ana Regional Transportation Center to A White and Yellow Cab Company <br />i to be used to accommodate a taxi cab company to provide transportation to travelers, visitors and employees at The <br />2 Santa Ana Regional Transportation Center. <br />o <br />lv <br />B. The parties hereto now desire to extend the term of said Agreement to provide uninterrupted service while the <br />City completes the public bidding process required to award a new Taxi License Agreement. <br />WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter contained and <br />made, and subject to all of the terms and conditions of said Agreement as hereby amended, the parties hereto do <br />hereby agree as follows: <br />1. The "Term" section of said Agreement shall be extended on a month -to -month basis for up to ninety (90) <br />days, through March 18, 2011, until the City Council awards a Taxi License Agreement. The parties specifically <br />agree that said Agreement shall immediately terminate upon the effective date of the new Taxi License Agreement. <br />2. Except as hereinabove modified, the terms and conditions of said Agreement, including the attached Rider, <br />remain unchanged and in full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this Extension of Taxi Cab License Agreement the <br />date and year first above written. <br />ATTEST: CITY OF SANTA ANA <br />N Maria D.
