INSURANCE Oil FILE <br />N-2011-011 <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />6�e, <br />CLERK OF COUNCIIJ AXI" CONSULTANT AGREEMENT <br />DATE:-) FEB 2 2011 <br />Tot1 �Q THIS AGREEMENT, made and entered into this 18 day of January. 2011 by and <br />z�rba between La Jolla Institute (hereinafter "Consultant"), and the City of Santa Ana, a charter city <br />and municipal corporation organized and existing under the Constitution and laws of the State <br />of California (hereinafter "City"). <br />RECITALS <br />A. The City desires to retain a consultant having special skill and knowledge in the field <br />of moderation for community forums. <br />B. Consultant represents that Consultant is able and willing to provide such services to <br />the City. <br />C. In undertaking the performance of this Agreement, Consultant represents that it is <br />knowledgeable in its field and that any services performed by Consultant under this <br />Agreement will be performed in compliance with such standards as may reasonably be <br />expected from a professional consulting firm in the field. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to <br />the terms and conditions hereinafter set forth, the parties agree as follows: <br />1. SCOPE OF SERVICES <br />Consultant shall moderate a study session with the City Council on progress in <br />implementing the City's recently updated Housing Element. The topics will include the City's <br />Housing Opportunity Ordinance (inclusionary housing concept) and the rezoning of land for <br />mixed-use and multifamily transit -oriented development along Harbor Boulevard (one of the <br />City's transit corridors). This scope includes preparation and coordination between <br />Consultant and City staff, as well as the creation of presentation materials and day-qf <br />facilitation. This scope of work assumes that the PowerPoint presentation will consist of a <br />compressed version of the Harbor Boulevard Open House presentatiQrn conducted in <br />December 2010, and will also draw from draft PowerPoint materials previously prepared by <br />the City for in-house discussions on the inclusionary concept. <br />2. COMPENSATION <br />a. The total sum to be expended under this Agreement, which City agrees to pay, and <br />Consultant agrees to accept as total payment for its services, shall not exceed $5,000.00 <br />during the term of this Agreement. <br />
