Ms. DeRosa provided a review of actions to date on the issue. <br />Kylee Otto, Deputy City Attorney, advised the Commission of Chapter 30 requirements. <br />She noted that after the conclusion of the EIR review period the demolition could take place <br />and that the Commission does not have the ability to delay it. <br />Commissioner Kings noted frustration over limited review and noted that potential relocation <br />sites had been researched. She requested that mitigation funds for the loss of historic <br />integrity be requested from the developer. <br />Commissioner Chinn noted that even if the EIR is approved the City Council could still deny <br />the project. He noted that he concurred with Commissioner Kings on mitigation for the loss <br />of historic integrity and that specific mitigation recommendations should be made. He also <br />noted that he disagreed with the provision allowing the developer to demolish the structures <br />prior to project approval. <br />Commissioner Bustamante asked if the properties were still available to interested persons. <br />Ms. Otto advised that they were available and outlined the process for obtaining the <br />properties. Commissioner Bustamante asked if any City funds were available to assist <br />interested persons and Ms. Otto advised that City Council would need to make that <br />determination. <br />Chairman Giles noted his agreement with Commissioners Kings and Chinn and that the <br />loss of the structures could not be remedied. He advised that he would support a <br />recommendation of $2.2 million for mitigation. Ms. Nelson recommended that the mitigation <br />request should be for the cost to relocate and rehabilitate, including the cost of land. <br />Motion to recommend mitigation for cultural Loss on the Broadway corridor an <br />amount to equal the cost of relocation and rehabilitation, including the cost of land, <br />from the developer if no other interest is expressed. <br />' MOTION: Kings SECOND: O'Caillaghan <br />AYES: Bustamante, Chinn, Corpin, Giles, Kings, Lutz, O'Callaghan, Schaefer (ti) <br />NOES: None (0) <br />ABSENT: Gartner (1) <br />ABSTAIN: None (0) <br />Ben Kaufman requested that the Commission determine if they wished to form an Ad Hoc <br />Committee to draft Commission response on the overall project. Discussion was held <br />regarding project timeline, issues to include in their response, and various options for <br />Commissioner input. <br />Chairman Giles appointed Commissioners Kings, Chinn, O'Callaghan, and Gartner to the <br />Ad Hoc Committee and requested their report be made available at the October meeting. <br />Ms. DeRosa noted that comments received after September 12, 2003 would not be <br />included in the response to comments on the EIR. Ms. Nelson encouraged the <br />Commissioners to comment as individuals prior to September 12 if they wished to meet the <br />legal parameters of the EIR process. <br />COMMENTS <br />3.
