• variance with the intent and purpose of the provisions of this <br />chapter. <br />Due to the unique location along a busy secondary arterial <br />street and contextual setting immediately adjacent to <br />similarly sized buildings, denial of the variance would deprive <br />the property owner the privilege of utilizing the facility to its <br />maximum potential and ensure the privileges for its patrons. <br />Unlike traditional residential lots, the property is located <br />along a major corridor and surrounded by uses and other <br />buildings of similar use and scale. <br />2. That the granting of a variance is necessary for the preservation <br />and enjoyment of one or more substantial property rights. <br />The granting of the variance would allow the property owner <br />the opportunity to install a church tower as found on similar <br />architectural themed buildings and church structures in the <br />immediate area. <br />3. That the granting of a variance will not be materially detrimental to <br />the public welfare or injurious to surrounding property. <br />The proposed church tower will be consistent with the <br />modern gothic architectural theme and materials found on <br />• the project site and nearby properties. The height and <br />appearance of the tower will blend with the existing building <br />and landscaping and will not be materially detrimental to the <br />public welfare or injurious to surrounding property. The <br />tower will be setback substantially from nearby properties <br />and will not interfere with the safety of pedestrians or <br />motorists entering or exiting the site. <br />4. That the granting of a variance will not adversely affect the General <br />Plan of the City. <br />The granting of the variance will not adversely affect the <br />City's General Plan in any way as the land use designation <br />of Low Density Residential (LR-7) allows churches and <br />accessory structures in the land use designation. <br />G. In accordance with the California Environmental Quality Act, the <br />recommended action is exempt from further review per Section <br />15061(b)(3). This general rule exemption applies to any project where it <br />can be seen with certainty that there is no possibility that the activity in <br />question may have a significant effect on the environment.
