OH - 02/28/11 <br />RESOLUTION NO. 2011-01 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF SANTA ANA APPROVING VARIANCE NO. <br />2011-01 AS CONDITIONED TO ALLOW A REDUCTION IN <br />LANDSCAPED SETBACKS FOR THE PROPERTY <br />LOCATED AT 1901 NORTH TUSTIN AVENUE <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA <br />AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Applicant is requesting approval of Variance No. 2011-01 to allow a <br />reduction in landscaped setbacks for a new medical office building at 1901 <br />North Tustin Avenue. <br />B. Variance No. 2011-01 came before the Planning Commission of the City <br />of Santa Ana for a duly noticed public hearing on February 28, 2011. <br />C. Variance No. 2011-01 has been filed with the City of Santa Ana seeking to <br />reduce the required landscaped setbacks along the street frontage in the <br />C1 district. Sections 41-368 and 41-369 of the Santa Ana Municipal Code <br />require a fifteen (15) foot setback for a front yard and a side yard adjacent <br />to a street for buildings on corner lots in the C1 district. In addition, <br />Section 41-372 of the Santa Ana Municipal Code requires a landscaped <br />area not less than fifteen (15) feet along any property line abutting a <br />street, except for paved driveways, in the C1 district. <br />D. Santa Ana Municipal Code Section 41-638 authorizes the Planning <br />Commission to grant a variance upon making certain findings. <br />That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location or <br />surroundings, the strict application of the zoning ordinance is found <br />to deprive the subject property of privileges not otherwise at <br />variance with the intent and purpose of provisions of this Chapter. <br />The project site has a special circumstance related to its <br />size, shape and location. The building was constructed in <br />the 1960s and was previously used by the Automobile Club <br />of Southern California (AAA). Subsequent to its construction <br />31 A-15
