301.2 Developer's Obligation to Construct Improvements. Subject to all of <br />the other terms and conditions set forth in this Agreement, upon the purchase of a Phase, <br />Developer shall develop or cause the development of the improvements on the Sites in such <br />Phase in accordance with the Scope of Development, the City of Santa Ana's Municipal Code, <br />and the plans, drawings and documents submitted by Developer and reasonably approved by the <br />City as set forth herein. <br />301.3 Developer Fee. Subject to the terms and conditions of this Agreement, <br />Agency shall disburse to Developer the Developer Fee, in an amount equal to Fifty Thousand <br />($50,000.00) per Affordable Unit payable to Developer upon close of escrow with a qualified <br />Homebuyer. <br />301.4 Required Improvements. The Developer shall develop the <br />Improvements in accordance with the Scope of Development and the plans, drawings and <br />documents submitted by the Developer and approved by the City as set forth herein. The <br />Improvements shall generally consist of the construction of the following: <br />The proposed project consists of development of 17 single family dwelling units on 10 sites <br />scattered throughout the city. The project will be built in 3 phases. The homes will be attached <br />and will offer 3 and 4 bedrooms.. The homes will be sold to 7 low income and 10 moderate <br />income home buyers. Agency's Obligations.
