Response Plans and Inventory), (iv) defined as a "hazardous substance" under Section 25281 of <br />the California Health and Safety Code, Division 20, Chapter 6.7 (Underground Storage of <br />Hazardous Substances), (v) petroleum, (vi) friable asbestos, (vii) polychlorinated byphenyls, <br />(viii) listed under Article 9 or Administrative Code, Division 4, Chapter 20, (ix) designated as <br />"hazardous substances" pursuant to Section 311 of the Clean Water Act (33 U.S.C. Section <br />1317), (x) defined as a "hazardous waste" pursuant to Section 1004 of the Resource <br />Conservation and Recovery Act, 42 U.S.C. Section 6901 et seq., (42 U.S.C. section 6903) or (xi) <br />defined as "hazardous substances" pursuant to Section 101 of the Comprehensive Environmental <br />Response, Compensation, and Liability Act, 42 U.S.C. section 9601 et seq. <br />"Homebuyer Documents" refers to the documents to be executed by the Homebuyer <br />upon purchase of the affordable House as set forth in Section 403.4. <br />"House" means the building and appurtenant structures located on a Parcel and designed <br />and intended for use and occupancy as a residence by a single Family. <br />"Household Size Appropriate for the Unit," for the purpose of determining Affordable <br />Housing Cost only, means four persons for a three bedroom Affordable Unit and five persons for <br />a four bedroom Affordable Unit. Household Size Appropriate for the Unit is not intended to <br />constitute a limitation on the number of persons who may live in the Unit. <br />"Improvements" means the improvements to be constructed by the Developer upon the <br />Sites in a Phase, all more specifically defined herein and in the Scope of Development. <br />"Lender" is defined in Section 311.2 hereof. <br />"Low Income" and "Low Income Households" shall mean persons and families whose <br />income does not exceed the qualifying limits for Low Income families in Orange County as <br />established by the State of California pursuant to Health and Safety Code section 50079.5, as <br />such qualifying limit is amended from time to time. <br />"Moderate Income" or "Moderate Income Households" shall mean persons and <br />families whose income does not exceed the qualifying limits for Moderate Income Households in <br />Orange County as established by the State of California pursuant to Health and Safety Code <br />section 50093, as such qualifying limit is amended from time to time. <br />"Monthly Housing Costs" shall mean (i) one-twelfth of the annual cost of principal and <br />interest payments on each loan secured by a mortgage on the Affordable Unit and loan insurance <br />fees, if any, associated with such mortgages; (ii) one-twelfth of the annual cost of property taxes <br />and assessments; (iii) one-twelfth of the annual cost of fire and casualty insurance covering <br />replacement value of property improvements; (iv) one-twelfth of the annual cost of property <br />maintenance and repairs; (v) one-twelfth of the annual cost of a reasonable allowance for utilities <br />the County Utility Schedule as adopted by the Santa Ana Housing Authority (as amended from <br />time to time), including garbage collection, sewer, water, gas, electricity, and other heating, <br />cooking or refrigeration fuels, but not telephone service, and (vi) one-twelfth of annual <br />homeowners association dues and assessments. <br />"Mortgage" is defined in Section 311.2 hereof. <br />5 EXHIBIT 4 <br />
