ROH — 04/04/11 <br />RESOLUTION NO. 2011 -022 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />APPROVING THE ADDENDUM TO THE FINAL ENVIRONMENTAL IMPACT <br />REPORT NO. 2004 -02 AND APPROVING THE MITIGATION MONITORING AND <br />REPORTING PROGRAM; APPROVING CONDITIONAL USE PERMIT NO. 2011 -05 <br />AS CONDITIONED; APPROVING VARIANCE NO. 2011 -04 AS CONDITIONED TO <br />ALLOW TANDEM PARKING; AND, APPROVING SITE PLAN REVIEW NO. 2011 -01 <br />AS CONDITIONED FOR THE PROPERTY LOCATED AT 100 -140 EAST <br />MACARTHUR BOULEVARD <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines and <br />declares as follows: <br />A. The Applicant is requesting approval of an addendum to a final environmental impact <br />report, an amendment to a development agreement, a conditional use permit, a <br />variance, and a site plan review to allow the construction of a new multi - family <br />residential development at 100 -140 East MacArthur Boulevard. <br />B. The Planning Commission has, following a duly noticed public hearing, on March 14, <br />2011, recommended approval of the following items: <br />1. Adopt a resolution approving the Addendum to the Final Environmental Impact <br />Report No. 2004 -02 and approve the Mitigation Monitoring and Reporting <br />Program. <br />2. Adopt an ordinance approving the fourth amendment to Development <br />Agreement No. 2005 -02. <br />3. Adopt a resolution approving Conditional Use Permit No. 2011 -05 as <br />conditioned. <br />4. Adopt a resolution approving Variance No. 2011 -04 as conditioned to allow <br />tandem parking. <br />5. Adopt a resolution approving Site Plan Review No. 2011 -01 as conditioned. <br />C. On April 4, 2011 the City Council of the City of Santa Ana held a duly noticed public <br />hearing and at that time considered all testimony, written and oral. <br />D. Conditional Use Permit No. 2011 -05 has been filed with the City of Santa Ana <br />seeking to allow the construction of a multi - family residential development at 100 -140 <br />East MacAuhur Boulevard. <br />Resolution No. 2011 -022 <br />Page 1 of 6 <br />
