by Event Producer. Event Producer shall produce a complete schedule for the <br />main stage listing each performer, their popularity rating, and their associated <br />time two weeks prior to each scheduled Event. City will provide final approval <br />within five working days of City receipt of entertainment schedule, at which time <br />City will provide written approval in the form of a letter from the City Manager <br />or his designee. As part of the entertainment package, Event Producer shall <br />incorporate at least one headliner for Saturday and Sunday as part of the <br />entertainment segment of the event. The headliner shall be a musician or group <br />that is recognized and established to be a regional draw within their music genre. <br />e) ENTERTAINMENT HOURS. The final entertainment shall end by 9:00 p.m. <br />Saturday and by 8:00 p.m. Sunday. Event Producer shall employ a stage <br />manager to ensure the entertainment agenda is followed. If Event Producer fails <br />to enforce the closure time. the Police Department will immediately close the <br />stage and disburse the crowd. Event Producer shall pay all City costs incurred in <br />enforcing the approved entertainment schedule. <br />t) STAGES. A minimum of two stages and associated entertainment shall be <br />programmed and. produced during the duration of Event 11. One stage shall be <br />located at the intersection of Mortimer and 4`h Street. A second stage shall be <br />located as mutually agreed between Event Promoter and City. For Event 1, <br />however, there shall only be one stage located at the intersection of Mortimer and <br />4"' Street. <br />g) ALCOHOL and TOBACCO. Event Producer agrees not to sell or distribute or <br />allow the sale of or distribution of any tobacco products during the Events. <br />Sponsorship by alcohol product companies shal I be allowed subject to pre - <br />approval by City. Absolutely no direct tobacco product advertising shall be <br />allowed within or associated with the Event. Neither tobacco product advertising <br />nor alcohol product advertising shall be distributed to minors. <br />h) PRESS RELEASES and PROMOTIONS. City shall receive copies of all press <br />releases and advertising for the event at least 72 hours prior to the use in the <br />Event promotion. City retains final approval of all promotional material for said <br />Events. Event Producer will provide to City all distributed documents related to <br />marketing, promotions and administration as distributed. All promotional <br />materials shall include the City logo. <br />SPONSORSHIP. City shall receive copies of all sponsorship agreements for the <br />Event. Event. Producer shall obtain City approval prior to contracting sponsor <br />benetits relating to the use of public spaces such as fag poles, banners and City <br />facilities. Additionally. City retains the right to approve all sponsor material <br />which identifies the City by name, logo or City seal. All sponsorship <br />agreements/contracts must be between MX I.Jve Entertainment (Event producer) <br />and the participating sponsor and not third parties; however, should a third -party <br />sponsorship present itself, MX l.Jve shall present to the City for consideration <br />and the City will have final approval of same. <br />j) FEES. Event Producer shall be responsible for all fees and/or costs associated <br />with both Event I and Event 11 including, but not limited to, Police, Dire, Code <br />
