Chapter 2 CEQA Findings <br />Level of <br />Significance after <br />Impact Statement Evidence/Rationale Supporting Findings Mitigation Measures Findings Mitigation <br />CULTURAL RESOURCES <br />Impact 4.4-1 Long-term <br />cumulative development <br />occurring pursuant to the <br />Transit Zoning Code could <br />cause a substantial adverse <br />change in the significance of <br />an archaeological resource or <br />disturb human remains. <br />Implementation of MM4.4-1(a) and <br />MM4.4-1(b) will ensure that adverse <br />impacts will not occur to archaeological <br />resources and/or human remains since it <br />involves pre-grading study as well <br />provisions for handling remains or artifacts <br />that are encountered unexpectedly. <br />Discussion is provided on pages 4.4-19 <br />and 20 of the FEIR (Volume 1). In addition, <br />Appendix D provides further evidence <br />supporting this impact and its associated <br />findings. <br />MM4.4-1(a) Prior to any earth-disturbing <br />activities (e.g., excavation, trenching, grading) <br />that could encounter undisturbed soils, the <br />project applicant shall retain an archaeologist <br />who meets the Secretary of the Interior's <br />Professional Qualifications Standards for <br />Archaeology to determine if the project could <br />result in a substantial adverse change in the <br />significance of an archaeological resource <br />pursuant to Section 15064.5 of the CEQA <br />Guidelines or disturb human remains. The <br />investigation shall include, as determined <br />appropriate by the archaeologist and the City <br />of Santa Ana, an updated records search of <br />the South Central Coastal Information Center <br />(SCCIC) of the California Historical <br />Resources Information System (CHRIS), <br />updated Native American consultation, and a <br />pedestrian survey of the area proposed for <br />development. The results of the investigation <br />shall be documented in a technical report or <br />memorandum that identifies and evaluates <br />any archaeological resources within the <br />development area and includes <br />recommendations and methods for <br />eliminating or avoiding impacts on <br />archaeological resources or human remains. <br />The measures shall include, as appropriate, <br />subsurface testing of archaeological <br />resources and/or construction monitoring by a <br />qualified professional and, if necessary, <br />appropriate Native American monitors <br />identified by the applicable tribe (e.g., the <br />Gabrielino Tonava Nation) and/or the Native <br />Finding 1 <br />The Agency finds that changes or alterations <br />have been required in, or incorporated into, the <br />project which would avoid or substantially <br />lessen the significant environmental effect as <br />identified in the final EIR. <br />Less than <br />significant <br />2-18 Revised Station District Project and FOL Settlement Agreement Findings of Fact/Statement of Overriding Considerations
