Small cell leaders. <br />RE: New Cingular Wireless Site Cell Site N 00O240 (10127664) <br />2115 West McFadden, Santa Ana, CA 92703 <br />Dear Landlord: <br />On April 19, 2011, New Cingular Wireless PCS, LLC ("Tenant") and The City of Santa Ana <br />("Landlord"), entered into a Land Lease Agreement ("Agreement"). <br />Under section 10 of the Agreement, ("Use/Maintenance") "...Lessee shall have the right to construct, maintain" <br />install, repair, and operate on the Premises radio communications facilities, including but not limited to, radio <br />frequency transmitting and receiving equipment, batteries, utility lines, transmission lines, radio frequency <br />transmitting and receiving antennas and supporting structures and improvements ("Lessee Facilities"). All <br />improvements shall be at Lessee's sole expense and the installation of all improvements shall be at the <br />discretion and option of the Lessee, with Lessor approval, which approval shall not be unreasonably withheld, <br />delayed or conditioned. Said approval shall be obtained by Lessor prior to commencement of any construction, <br />alterations, modifications or improvements pursuant to Section 9...". The consent form and plans dated <br />09/09/17 are attached hereto for the Landlord's signature. <br />Within the next 6 months (approximately), Tenant intends to access the Premises with its employees, <br />agents, contractors and subcontractors for the purpose of upgrading and conducting maintenance work <br />necessary to enhance the performance of its LTE network at this facility. All modifications to be within <br />existing lease Premises thus no expansion of current lease space is required. <br />Kindly sign and complete this letter below on Page 2.
