A-2011-006 <br />-« <br />1K MAY <br />SECOND AMENDMENT TO <br />AGREEMENT BETWEEN THE CITY OF SANTA ANA <br />JE APR $ 201t AND OLIVE CREST FOR THE USE OF <br />HOMELESSNESS PREVENTION AND <br />RAPID REHOUSING GRANT FUNDS <br />4 <br />THIS SECOND AMENDMENT TO AGREEMENT is entered into on the q-010-f <br />p January 2011, by and between Olive Crest, a California non-profit corporation ("Subrecipient") <br />and the City of Santa Ana, a charter city and municipal corporation organized and existing under <br />the Constitution and laws of the State of California ("City"). <br />RECITALS: <br />1 A. The parties entered into that certain Agreement Between the City of Santa Ana and Olive <br />V Crest for Use of Homelessness Prevention and Rapid Rehousing Grant Funds (Program Year <br />2009-10), dated September 30, 2009, (hereinafter "said Agreement") by which Subrecipient <br />has been providing support to the homeless youth or those who are at risk for homelessness. <br />B. The parties previously amended the Scope of Work for the services that Subrecipient <br />provides to the City. <br />C. The HPRP program requires, by statute, that grantee's expend 60% of its award funds within <br />two years of the date that the U.S. Department of Housing and Urban Development ("HUD") <br />signed the grant agreement. HUD may recapture and reallocate unused HPRP funds if a <br />grantee cannot meet this requirement. <br />D. Based upon current expenditure rates and projections as to whether each grantee can meet <br />this requirement, the parties hereto have agreed to this amendment. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br />the terms and conditions of said Agreement, except those amended in this Second Amendment to <br />Agreement, the parties agree as follows: <br />1. The Scope of Work and Budget that are referenced in the Agreement shall be amended and <br />replaced with the revised Exhibit A attached hereto and incorporated herein. <br />2. Section VI, A. "Agreement Amount" shall be reduced by $103,000, due to the reduced <br />services. <br />3. The City Manager is authorized to execute future amendments to the Scope of Services, <br />change in funding amount or milestone dates with regard to HPRP Subrecipient Agreements <br />that were previously approved under the HPRP Program. <br />4. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />
