,• v ;sj ANCE NOT ON FIF A- 2011 -004 <br />Mk <br />NQT PROCEED <br />OF COUNCIL <br />"R252011 <br />AMENDMENT TO <br />- -AGREEMENT BETWEEN THE CITY OF SANTA ANA <br />cn AND AIDS SERVICES FOUNDATION FOR THE USE OF <br />W HOMELESSNESS PREVENTION AND <br />RAPID REHOUSING GRANT FUNDS <br />THIS AMENDMENT TO AGREEMENT is entered into on the _q day of <br />20A, by and between Aids Services Foundation, a California non - profit <br />corporation ( "Subrecipient ") and the City of Santa Ana, a charter city and municipal corporation <br />organized and existing under the Constitution and laws of the State of California ( "City "). <br />RECITALS: <br />A. The parties entered into that certain Agreement Between the City of Santa Ana and Aids <br />Services Foundation for Use of Homelessness Prevention and Rapid Rehousing Grant Funds <br />(Program Year 2009 -10), dated September 30, 2009, (hereinafter "said Agreement ") by <br />which Subrecipient has been providing support to homeless women or those who are at risk <br />for homelessness under the Homelessness Prevention and Rapid Re- Housing program <br />( "HPRP "). <br />B. The HPRP program requires, by statute, that grantee's expend 60% of its award funds within <br />two years of the date that the U.S. Department of Housing and Urban Development ( "HUD ") <br />signed the grant agreement. HUD may recapture and reallocate unused HPRP funds if a <br />grantee cannot meet this requirement. <br />C. Based upon current expenditure rates and projections as to whether each grantee can meet <br />this requirement, the parties hereto have agreed to this amendment. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br />the terms and conditions of said Agreement, except those amended in this Amendment to <br />Agreement, the parties agree as follows: <br />1. The Scope of Work and Budget that are referenced in the Agreement shall be amended and <br />replaced with the revised Exhibit A attached hereto and incorporated herein. <br />2. Section VI, A. "Agreement Amount" shall be reduced by $73,000, due to the reduced <br />services. <br />3. The City Manager is authorized to execute future amendments to the Scope of Services, <br />change in funding amount or milestone dates with regard to HPRP Subrecipient Agreements <br />that were previously approved under the HPRP Program. <br />4. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />
