SECOND AMENDMENT TO AGREEMENT N-2009-057-002 THIS SECOND AMENDMENT TO AGREEMENT is entered into this it day of, " 1` , 2011, by and between Community Veterinary Hospital, Inc., a California corporation ("Consultant") and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). Recitals: A. The parties entered into Agreement #N-2009-057, dated May 20, 2009, (hereinafter "said Agreement") by which Consultant has provided veterinary medicine and services for Police Service Animals. B. The parties entered into First Amendment to Agreement #N-2009-057-001, dated June 10, 2010, to renew the term of said Agreement for an additional one-year period and update the scope of services and rates for Consultant's services. C. In accordance with the terms and conditions of said Agreement, the parties wish to renew the term of said Agreement for an additional one-year period and increase compensation to provide for services during the extended term. Wherefore, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of the Agreement, except those amended in this Second Amendment to Agreement, the parties agree as follows: 1. Section 2, COMPENSATION, subsection a, shall be amended to increase compensation to pay for services during the extended term. The total sum to be expended under this Agreement shall not exceed $25,000.00, annually, during the amended term of this Agreement. 3. Section 3, TERM, shall be amended to extend the term for an additional one-year period, from July 1, 2011 through June 30, 2012. 4. Except as hereinabove modified, all terms and conditions of said Agreement shall remain in full force and effect.
