N-2011-070 <br />PC i -)RIGHT OF ENTRY AND <br />M, �" 1y Lam% COST SHARING AGREEMENT <br />FOR THE INSTALLATION OF PUBLIC IMPROVEMENTS <br />THIS AGREEMENT made and entered into this — day of "4 1 2011 by and <br />between VICTORY PROPERTY HOLDINGS, LLC ("Owner") and the CITY OF SANTA <br />ANA, a municipal corporation of the State of California ("City"). <br />RECITALS: <br />A. The City has commenced Residential Street Repair Project, Phase 15 ("the Project") <br />to repair the existing asphalt pavement and replace damaged concrete curb, gutter, <br />sidewalk, cross gutter and curb ramp on various City streets. <br />B. The property located at 518 N. Poinsettia Street, Santa Ana, California (hereinafter, <br />"Property"), more particularly described in Exhibit A, attached hereto and <br />incorporated by reference, and owned by Victory Property Holding, LLC ("Owner"), is <br />located within the boundaries of the Project. <br />C. The Owner of the Property desires that a sidewalk be installed adjacent to the <br />Property at the Owner's cost. <br />D. The City is able to perform the sidewalk improvement in conjunction with the Project <br />on behalf of the Owner, at the Owner's expense. <br />E. The Owner, by execution of this Agreement, desires to provide assurances to the <br />City that the cost of the sidewalk improvements will be paid to the City in a timely <br />manner. <br />WHEREFORE, in consideration of the foregoing, the parties hereby agree as follows: <br />1. City shall complete the design and construction of sidewalk improvements at 518 N. <br />Poinsettia Street, Santa Ana, California, as follows: <br />a. Construct two driveways and full width (12' wide) sidewalk, with cutouts for three <br />tree wells on the west side of N. Poinsettia Street between 5`h Street and 6`" <br />Street. Said work includes 60 cubic yards of unclassified excavation, 2449 <br />square feet of concrete sidewalk, 460 square feet of concrete driveway, and <br />remove and replace 315 square feet of concrete pavement on site. <br />The above described construction shall be referred to as "Sidewalk <br />Improvements". <br />b. City, at its cost, will install curb and gutter adjacent to said Sidewalk <br />Improvements. <br />2. The estimated cost of the Sidewalk Improvements is $20,182, including design <br />engineering, construction and construction administration. The Owner shall deposit <br />the sum of $20,182 with the City upon execution of this Agreement. <br />
