Include written or oral comments concerning the Plan and the Developer's <br />response as an attachment when it is forwarded to the appropriate <br />governmental body for approval. <br />~y. 6 1141 t(:.i~ & "1`it 3ti '~ ] .~`i iJ <br />Federal legislation (PL105-I 17) prohibits the paymenft"sf relocation assistance benefits under <br />the Uniform Act to any alien not lawfully present in the United States. unless such <br />ineligibility would result in an exceptional attd` extremely`ttnusual hardship'' fo=-~he alien's <br />spouse, parent, or child any of whom is a citizen.or ar alien admitted foi permanent <br />residence. Exceptional and extremely unusual hardship is defined as significant and <br />demonstrable adverse impact on the health or safety, continued existence of the family unit, <br />and any other impact determined by tfie Developer to negatively affect the alien's spouse, <br />parent or child. The Developer will authq~ize the payment ~~ relocation assistance <br />benefits to alien residents from non-federally authorized reimbursable funds. <br />In order to track and accari~it for_relocation assistance and benefit payments, relocation staff <br />will be required to s~pek immigration status information from each displacee 18 years and <br />alder by having therri"self.-.certify as to their legal status. <br />If 104(d) rules apply to a'household, based 4i the procurement of HOME funds for the <br />proposed $rr~ject legal .,presence ,in the United States is not required in order to receive <br />r;}„ <br /> <br />All displaced occupants mil receive a 90-day notice to vacate before they are required to <br />move.
