Section 307. Agency Approval of Plans Drawings and Related Documents <br />The Agency shall have the right of reasonable review (including, but not limited to, <br />architectural review) of all plans, drawings and related documents for the development, including <br />any proposed changes therein. The Agency shall approve or disapprove such plans, drawings, and <br />related documents referred to in this Agreement (and any proposed changes therein) within the <br />times established in the Schedule of Performance. Such approval shall not be unreasonably <br />withheld. Any disapproval shall state in writing the reasons for disapproval. The Developer, upon <br />receipt of a disapproval, shall revise such portions of the plans, drawings or related documents in a <br />manner that satisfies the reasons for disapproval and shall resubmit such revised portions to the <br />Agency as soon as possible after receipt of the notice of disapproval. Plans, drawings, and related <br />documents receiving Agency approval shall not be subsequently disapproved. <br />Section 308. Cost of Construction <br />The cost of developing the Property and of constructing all improvements thereon shall be <br />borne by the Developer, except as otherwise expressly provided in this Agreement. <br />Section 309. Construction of the Long-Term Use <br />A. Developer agrees, at its own cost and expense, including cost of design plans and <br />specifications, to install or construct or cause to be installed or constructed sidewalks, curbs, gutters, <br />culverts, pavement, street lights and any other off-site improvements as may be required for <br />development of the Property by the City of Santa Ana as part of the long-term use, all in accordance <br />with technical specifications, standards and practices of the City of Santa Ana. <br />B. Developer shall contract with a general contractor, licensed as such by the State of <br />California, for all such construction work. <br />12 <br />3-18 <br />
