Section 312. Reserved <br />Section 313. Antidiscrimination During Construction <br />The Developer for itself and its successors and assignees agrees that in the construction of <br />the improvements on the Property provided for in this Agreement, the Developer will not <br />discriminate against any employee or any applicant for employment because of sex, marital status, <br />race, color, religion, creed, national origin or ancestry. <br />Section 314. Compliance with Governmental Requirements <br />Developer shall carry out the design, construction, and operation of the Project in substantial <br />conformity with all applicable laws, ordinances, statutes, codes, rules, regulations, orders, and <br />decrees of the United States, the State of California, the County of Orange, the City, or any other <br />political subdivision in which the Property is located, and of any other political subdivision, agency, <br />or instrumentality exercising jurisdiction over the City, the Developer or the Property, including all <br />applicable federal, state, and local occupation, safety and health laws, rules, regulations and <br />standards, applicable state and labor standards, applicable prevailing wage requirements, the City <br />zoning and development standards. City permits and approvals, building, plumbing, mechanical and <br />electrical codes. as they apply to the Property and the Project, and all other provisions of the City <br />and its Municipal Code (as they apply to the Property and the Project), and all applicable disabled <br />and handicapped access requirements, including, without the limitation, the Americans With <br />Disability Act, 42 U.S.C. § 1210] et seg., Government Code ~ 4450 et seg., and the Unruh Civil <br />Rights Act, Civi] Code § 51 et seq. ("Governmental Requirements"). <br />Section 315. Right of Holders of Security Interests <br />A. The holder of any mortgage, deed of trust, or other security interest authorized by this <br />Agreement shall in no way be obligated by the provisions of this Agreement to construct or <br />complete the improvements or to guarantee such construction or completion; nor shall any <br />covenant or any other provision in a deed for any portion of the Property be constructed so <br />to obligate such holder. Nothing in this Agreement shall be deemed to construe, permit, or <br />authorize any such holder to devote the Property to any uses, or to construct any <br />improvements thereon, other than those uses or improvements provided for or authorized by <br />this Agreement. <br />B. Whenever the Agency shall deliver any notice or demand to the Developer with respect to <br />any breach or default by the Developer in completion of construction of the improvements, <br />the Agency shall at the same tune deliver to each holder of record of any mortgage, deed of <br />trust or other security interest authorized by this Agreement a copy of such notice or <br />demand.
