Section 402 Reserved <br />Section 403. Obligation to Refrain from Discrimination <br />The Developer covenants and agrees for itself, its subcontractors and every successor in <br />interest to the Property or any party thereof, that there shall be no discrimination against or <br />segregation of any person, or group of persons, on account of sex, marital status, race, color, <br />religion, creed, national origin or ancestry in the sale, lease, sublease, transfer, use, occupancy, <br />tenure or enjoyment of the Property, nor shall be Developer itself or any person claiming under or <br />through it, establish or permit any such practice or practices of discrimination of segregation with <br />reference to the selection, location, number, use or occupancy of tenants, lessees, subtenants, <br />sublessees, or vendees of the Property. <br />Section 404. Maintenance of the Site <br />Solely at the Developer's expense, the Developer shall maintain or cause to be maintained <br />the Property and all improvements thereon (including but not limited to the landscaping) in good <br />order, condition and appearance. Developer shall keep the Property reasonably free from any debris <br />and waste material. <br />If, at any time, Developer fails to maintain or cause to be maintained the Property as <br />required by this section, and said condition is not corrected after the expiration of a reasonable <br />period of time not to exceed thirty (30) days from the date of written notice from the Agency, either <br />the Agency or the City may perform the necessary landscape or other maintenance and Developer <br />shall pay all costs incurred for such maintenance. <br />Section 405. Reserved <br />Section 406. Effect, Recordation and Duration of Covenants <br />The covenants established in this Article shall, without regard to technical classification and <br />designation, be binding on Developer and any successor in interest to its interest in the Property or <br />any part thereof or any improvements thereon for the benefit and in favor of the Agency, its <br />successors and assigns, and the City. The covenant against discrimination shall remain in effect in <br />perpetuity. All other covenants shall remain in effect until July 2, 2026. Developer agrees that the <br />covenants set forth in this Article shall be included in the deed by which the Property is conveyed <br />by Agency to Developer, in the form set forth in Attachment No. 5, attached hereto and <br />incorporated herein (the "Deed"). <br />18 <br />3 - 24 <br />
