A-2011-173A <br />MEMORANDUM OF UNDERSTANDING <br />Between the County of Orange, by and through the Orange County Sheriff-Coroner <br />Department, and the City of Santa Ana Regarding the Assignment of a Santa Ana <br />Police Corporal to the Sheriff's Air Support Unit <br />ARTICLE I: PURPOSE <br />This Memorandum of Understanding (MOU) is entered into by the County of <br />Orange, by and through the Orange County Sheriff-Coroner Department (hereinafter <br />"COUNTY") and the City of Santa Ana (hereinafter "CITY), collectively referred to as <br />"the parties". This MOU establishes and defines a partnership between the parties that <br />will allow for the assignment of a CITY employee to the SHERIFF's Air Support Unit to <br />function as a pilot , to learn the operations of the SHERIFF's Air Support Unit and to <br />provide an opportunity for the parties to develop and practice interagency protocols. <br />ARTICLE II: SCOPE <br />The parties acknowledge that law enforcement aviation units are beneficial <br />supplements to traditional ground units. <br />The parties acknowledge that it is in the public interest to enhance cooperation <br />among City and County law enforcement agencies. <br />The parties acknowledge that the COUNTY and the CITY have entered a <br />separate Agreement whereby the COUNTY will provide law enforcement helicopter <br />services to the CITY. <br />ARTICLE III: CITY DUTIES <br />CITY shall provide a full-time sworn police officer employed by the CITY <br />(hereinafter "CITY's corporal") for assignment to the SHERIFF's Air Support Unit. <br />CITY's corporal is and shall be acting at all times as an employee of CITY and <br />not as an employee of COUNTY. Nothing herein contained shall be construed as <br />creating the relationship of employer and employee, or principal and agent, between <br />COUNTY and CITY's corporal. Salary, benefits and overtime of CITY's corporal will be <br />paid by CITY. CITY shall be responsible for any and all payment of Income Tax, Social <br />Security, State Disability Insurance Compensation, Unemployment Compensation and <br />other payroll deductions of CITY's corporal. <br />Responsibility for the conduct of CITY's corporal will remain with the CITY. <br />Evaluation and investigation of any complaints regarding CITY's corporal will be <br />referred to CITY. Disciplinary actions against CITY's corporal will be undertaken or <br />administered solely by CITY. <br />Page 1 of 5
