RUC 18 <br />20rJ <br />pM/•4- Souv? <br />?'y'??i Amendment #1 to the <br />Purchase and Sale Agreement of Real Property <br />and Bilateral Escrow Instructions <br />N-2009-'129-001 <br />THIS IRST AMENDMENT ("First Amendment") is made and entered into as of <br />?S 201 1 , by and between the CITY. OF SANTA ANA (hereinafter called <br />"B er" and MORRISETTE FAMILY TRUST (hereinafter called "Seller") and is intended to <br />modify the terms of that Purchase and Sale Agreement for Acquisition of Real Property and <br />Bilateral Escrow Instructions (herein called "Agreement") dated November 17, 2009 and <br />executed by Buyer and Seller (collectively called "Parties"). <br />WHEREAS, the City of Santa Ana acquired a 186 square foot permanent easement and <br />216 square foot temporary construction easement (Easements), recorded November 30, <br />2009: and <br />WHEREAS, the City of Santa Ana paid Eight Thousand Forty-Five Dollars ($8,045.00) for <br />Easements on December 21 . 2009: and <br />WHEREAS, the City of Santa Ana now requires an additional 48 square foot permanent <br />easement and an additional 142 square foot temporary construction easement to <br />accommodate the installation of the new sidewalk along Grand Avenue, pursuant to the <br />Americans with Disability's Act (ADA), and as legally described and depicted as Parcel B <br />& Parcel B-1 in Exhibits A, A-1 and B attached hereto; and <br />WHEREAS, the City is willing to adjust the compensation paid for said Easements. <br />Now, therefore, the Parties agree as follows: <br />Seller agrees to sign new Easements; and <br />2. The City will pay Seller Two Thousand Four Hundred Eighty-Eight Dollars <br />($2,488.00) for Easements; and <br />This Amendment shall amend, modify and supersede, to the extent of any inconsistencies, the <br />provisions of the Agreement, as amended. Except as expressly affected by this Amendment, the <br />Agreement shall remain in full force and effect. Any reference to the Agreement shall be <br />deemed to reference the Agreement as amended by this Amendment.
