An executive or employee of the Contractor, an elected official in the area of a member of the South <br />Bay Workforce Investment Board (SBWIB, Inc. shall not solicit or accept money or any other <br />consideration from a third person, for the performance of an act reimbursed in whole or part by the <br />Contractor or Sub-contractor. Supplies, materials, equipment or services purchased with subgrant <br />funds shall be used solely for purposes allowed under this Agreement. <br />No member of the SBWIB, Inc. shall cast a vote on the provision of services by that member (or any <br />organization which that member represents) or vote on any matter which would provide direct <br />financial benefit to that member of any business or organization which the member directly <br />represents. <br />Avoidance of Sectarian Activities. <br />The Contractor certifies that this Agreement does not provide for the advancement or aid to any <br />religious sect, church, creed or sectarian purpose nor does it help to support or sustain any school, <br />college, university, hospital or other institution controlled by any religious creed, church or sectarian <br />denomination whatever, as specified by Article XVI, Section 5, of the Constitution, regarding <br />separation of Church and State. <br />Unallowable Activities and Costs. <br />Contractor will comply with the guidelines per 20 CFR Part 652, WIA Final Rule, August 11, 2000, <br />regarding unallowable activities and costs or compensation may be disallowed. The following <br />activities and costs, among others, are specifically unallowable: <br />Public Service Employment: No funds will be used under this Agreement for public service <br />employment, subsidized employment with public and non-profit employers providing public <br />services, except to provide disaster relief employment as specifically authorized in section <br />173(d), (WIA SEC. 195(10). <br />2. Sectarian Activities: The employment or training of participants to carry out the construction, <br />operation, or maintenance of any part of any facility that is used or to be used for sectarian <br />instruction or as a place for religious work activities is prohibited. <br />3. Political Activities: No financial assistance may be provided for any program which involves <br />political activities. <br />4. Maintenance of Effort: <br />a. No currently employed worker shall be displaced by any participant (including partial <br />displacement, such as a reduction in hours of non-overtime work, wages or employment <br />benefits) any currently employed employee (as of the date of the participation). <br />b. No program shall impair existing contracts for services or collective bargaining <br />agreements, except that no program under this act which would be inconsistent with <br />the terms of a collective bargaining agreement shall be undertaken without the <br />written concurrence of the labor organization and employer concerned. <br />c.
