California State Constitution means a distinct benefit over and above general benefits conferred on real property <br />located in the District or to the public at large. <br />The property uses within the boundaries of the Modified Downtown Santa Ana CMD are a mix of office, retail, <br />entertainment, civic, governmental, residential and parking. Services, programs and improvements provided by the <br />District are primarily designed to provide special benefits to all parcels within the boundaries of the district. <br />Residential land uses will fund enhanced maintenance and security special benefit services which will be responsive <br />to their daily needs. <br />Existing City of Santa Ana services will be enhanced, not replaced or duplicated, by the continued CMD services. In <br />the case of the Modified Downtown Santa Ana CMD, the very nature of the purpose of this District is to fund <br />supplemental programs, improvements and services within the modified CMD boundaries above and beyond what is <br />being currently funded either via normal tax supported methods or other funding sources. These services, programs <br />and improvements, are designed to enhance the commercial core uses, increase tenancy and marketing of the <br />commercial entities in the CMD and improve the aesthetic appearance of the CMD as a whole. All benefits derived <br />from the assessments to be levied on parcels within the modified CMD are for services, programs and improvements <br />directly benefiting the property and business owners within this area and support increased security, cleanliness, <br />commerce, business attraction and retention, increased property rental income and improved District identity. No <br />services will be provided beyond the modified CMD boundaries. The proposed services, programs and improvements <br />which will provide special benefit to the properties within the modified CMD boundaries are described below: <br />1. Maintenance and Landscaping Services <br />Maintenance may include sidewalk sweeping and pressure washing, gum removal, graffiti <br />abatement, trash and /or bulky item removal; the watering, weeding and pruning of all trees and <br />plantings; alley /median /parkway maintenance; litter and debris pick -up; trash receptacle <br />collection /disposal and maintenance /replacement; and other maintenance and landscaping issues <br />that may arise. <br />Each maintenance service will assist in beautifying the Modified Downtown District and enhancing <br />the image of the commercial core. This activity is designed to increase customer comfort within <br />the greater Downtown which will, in turn, increase commerce and help to attract and retain new <br />businesses and patrons within the modified District. These maintenance services will be provided <br />only within the modified District; therefore, these services constitute "special benefits" to the <br />assessed parcels. <br />7 <br />
