EXHIBIT C <br />of Orange a request for a copy of any notice of sale or notice of default under any deed of trust or <br />mortgage with power of sale encumbering the Property or any party thereof. Disposition of the Property Contrary to Agreement. If the Owner disposes <br />of the Property contrary to this Deed of Trust, the City shall at any time thereafter, at its election, <br />have the right to declare such disposition or other act null and void and/or seek enforcement of <br />the terms and conditions hereof in any manner allowed by law or equity. <br />3. Severability. The provisions of this Deed of Trust, including without limitation, <br />shall be deemed independent and severable, and a determination of invalidity or partial invalidity <br />or unenforceability of any one provision or portion hereof by a court of competent jurisdiction <br />shall not affect the validity or enforceability of any other provisions hereof. <br />ARTICLE II. GENERAL CONDITIONS/MAINTENANCE <br />1. Maintenance. The Trustor agrees that at all times prior to the date upon <br />which the Loan Amount has been fully repaid to the Beneficiary and all other obligations the <br />performance of which is secured by this Deed of Trust have been satisfied (the "Expiration <br />Date") the Trustor will, at the Trustor's own expense, maintain, preserve and keep the Property <br />or cause the Property to be maintained, preserved and kept in a condition substantially similar to <br />other residential property similar in size, character, and quality to the Property consisting only of <br />those uses allowed by the Agreement. The Trustor will make or cause to be made all repairs, <br />replacements and renewals deemed proper and necessary by Trustor. The Beneficiary shall have <br />no responsibility in any of these matters or for the making of improvements or additions to the <br />Property. Owner, or its successor or assigns, shall maintain the Property in compliance with all <br />applicable housing quality standards, and all applicable local code requirements, and shall keep <br />the Property free from any unreasonable accumulation of debris or waste materials. All graffiti <br />and defacement of any type, must be removed and any necessary repairs made within five (5) <br />days of their creation and/or notice to the Owner. <br />2. Monitoring by the City. On or about July 1 of each calendar year, the City will mail a <br />form to the record owner of the Property to confirm that the Property is owner-occupied. The <br />owners of the Property shall complete the form and return it to the City within thirty (30) <br />calendar days after receipt of the request from the City. <br />3. Owner Occupancy. The Trustor agrees and covenants to use the Property as its <br />primary residence in full compliance with this Agreement for Forty-Five (45) years. City and <br />Owner acknowledge that this owner-occupancy covenant is a condition to and consideration for <br />Owners eligibility for the Neighborhood Stabilization Program Homeownership Program. <br />City.HO.DOT Page 4 of 13 2/8/10
