AMENDMENT TO <br />AGREEMENT BETWEEN THE CITY OF SANTA ANA <br />AND THE PUBLIC LAW CENTER FOR THE USE OF <br />HOMELESSNESS PREVENTION AND <br />RAPID REHOUSING GRANT FUNDS <br />THIS AMENDMENT TO AGREEMENT is entered into on the 16th day of August 2011, <br />by and between the Public Law Center, a California non-profit corporation ("Subrecipient") and <br />the City of Santa Ana, a charter city and municipal corporation organized and existing under the <br />Constitution and laws of the State of California ("City"). <br />RECITALS: <br />A. The parties entered into that certain Agreement Between the City of Santa Ana and the <br />Public Law Center for Use of Homelessness Prevention and Rapid Rehousing Grant Funds <br />(Program Year 2009-10), dated September 30, 2009, (hereinafter "said Agreement") by <br />which Subrecipient has been providing support to homeless persons and/or those who are at <br />risk for homelessness under the Homelessness Prevention and Rapid Re-Housing program <br />("HPRP"). <br />B. The City's HPRP program requires that grantees expend 100% of its award funds by June 20, <br />2012. HUD may recapture and reallocate unused HPRP funds if grantee cannot meet this <br />requirement. <br />C. Based upon current expenditure rates and projections as to whether each grantee can meet <br />this requirement, the parties hereto have agreed to this amendment to decrease funding for <br />this Subrecipient. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br />the terms and conditions of said Agreement, except those amended in this Amendment to <br />Agreement, the parties agree as follows: <br />1. The Budget that is referenced in the Agreement as "Exhibit B" shall be amended and <br />replaced with a revised Exhibit B due to this Amendment. <br />2. Section VI, A. "Agreement Amount" for the Homelessness Prevention grant shall be <br />decreased by $17,500. <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />1 <br />EXHIBIT 4 <br />25D-18
