<br /> <br /> <br /> <br /> i <br /> <br /> <br /> <br /> 1 any applicant shall be cause for termination of that employee. <br /> <br /> 2 27.3 Where authorized by law, CONTRACTOR shall conduct, at no cost to <br /> 3 the COUNTY, criminal record background checks on all employees and/or <br /> <br /> 4 volunteers who will provide services under this Agreement, Candidates will <br /> 5 satisfy background checks consistent with and comparable to those required for <br /> <br /> 6 COUNTY employees. <br /> 7 27.4 CONTRACTOR warrants that all persons employed or otherwise <br /> <br /> 8 assigned by CONTRACTOR to provide services under this Agreement have <br /> 9 satisfactory past work records and/or reference checks indicating their <br /> <br /> 10 ability to perform the required duties and accept the kind of responsibility <br /> 11 anticipated under this Agreement. CONTRACTOR shall maintain records of <br /> <br /> 12 background investigations and reference checks undertaken and coordinated by <br /> 13 CONTRACTOR for each employee and/or volunteer assigned to provide services <br /> <br /> 14 under this Agreement for a minimum of five (5) years from the date of final <br /> <br /> 15 payment under this Agreement or until all pending COUNTY, State and Federal <br /> 16 audits are completed, whichever is later, in compliance with all applicable <br /> I <br /> 17 laws. <br /> 18 27.5 CONTRACTOR shall immediately notify ADMINISTRATOR concerning the <br /> <br /> 19 arrest and/or subsequent conviction, for offenses other than minor traffic <br /> 20 offenses, of any paid employee and/or volunteer staff performing services <br /> <br /> 21 under this Agreement, when such information becomes known to CONTRACTOR. <br /> 22 ADMINISTRATOR, in its sole discretion, may determine whether, such employee <br /> <br /> 23 and/or volunteer may continue to provide services under this Agreement and <br /> 24 shall provide notice of such determination to CONTRACTOR in writing. <br /> <br /> 25 CONTRACTOR's failure to comply with ADMINISTRATOR's decision shall be deemed a <br /> 26 material breach of this Agreement, pursuant to Paragraph 18 above. <br /> <br /> 27 27.6 COUNTY has the right to approve or disapprove all of CONTRACTOR's <br /> 28 staff performing work hereunder and any proposed changes in CONTRACTOR's <br /> <br /> <br /> (WAM0811) 30 of 40 (December 22, 2011) <br /> <br /> 20B-32 <br />
