O-_ SA'PD C2� N- 2006 - '105 -006 Lori 13rawh 3 2Q�� FIFTH AMENDMENT TO JAN 1 CONSULTANT AGREEMENT THIS FIFTH �IENDMENT TO CONSULTANT AGREEMENT is entered into on this ) � day of 2011, by and between LUIS RAUL MARTINEZ ( "Consultant ") and the City of Santa Ana, a charter city and municipal corporation of the State of California ( "City "). RECITALS: A. The parties entered into Agreement N- 2006 -105, dated October 2, 2006, (hereinafter "said Agreement ") by which Consultant has provided counseling and instructional services for inmates at the Santa Ana Detention Facility. B. In accordance with the terms and conditions of said Agreement, the parties wish to renew said Agreement for an additional one -year period, amend the scope to increase hours of monthly instruction, and increase compensation to pay for additional services provided during the extended term. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, as previously amended, except those amended in this Fifth Amendment to Consultant Agreement, the parties agree as follows: 1. Section 1, SCOPE, shall be amended to increase hours of instruction to up to 40 hours per month. 2. Section 2.a., COMPENSATION, shall be amended to increase compensation to an amount not to exceed $20,000.00 during the extended term. 3. Section 3, TERM, shall be amended to extend the termination date one year, from June 30, 201 1, through June 30, 2012. In order to provide continuous uninterrupted service, all services provided by Consultant since July 1, 2011, shall be included within the Scope of Services of this Agreement. 4. Except as herein amended, all terms and conditions of said Agreement, as previously amended, shall remain in full force and effect.
