TENTH AMENDMENT TO <br />CONSULTANT AGREEMENT <br />THIS TENTH AMENDMENT TO CONSULTANT AGREEMENT is entered <br />into on thisZC7 day of ?P ? ? rn ,be? , 2011, by and between DANIEL ACHATZ <br />("Consultant") and the City of Santa Ana ("City"). <br />RECITALS: <br />A. The parties entered into Consultant Agreement N-2002-048, dated February 28, 2002, <br />(hereinafter "said Agreement") by which Consultant has provided counseling and <br />instructional services to the inmates at the Santa Ana City Jail. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />renew said Agreement for an additional one-year period, amend the scope to increase <br />hours of monthly instruction, and increase compensation to pay for additional <br />services provided during the extended term. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, as previously amended, except <br />those amended in this Tenth Amendment to Consultant Agreement, the parties agree as <br />follows: <br />1 . Section 1, SCOPE, shall be amended to increase hours of instruction to up to 40 hours <br />per month. <br />2. Section 2.a., COMPENSATION, shall be amended to increase compensation to an <br />amount not to exceed $20,000.00 during the extended term. <br />3. Section 3, TERM, shall be amended to extend the termination date one year, from <br />June 30, 2011, through June 30, 2012. In order to provide continuous uninterrupted <br />service, all services provided by Consultant since July 1, 2011, shall be included <br />within the Scope of Services of this Agreement. <br />4. Except as herein amended, all terms and conditions of said Agreement, as previously <br />amended, shall remain in full force and effect. <br />/// <br />/// <br />/// <br />1 U
