<br /> <br /> <br /> <br /> <br /> FIRST AMENDMENT TO SERVICE AGREEMENT <br /> <br /> <br /> THIS FIRST AMENDMENT TO AGREEMENT is entered into on February 21, 2012, <br /> by and between Service First Contractors Network dba Service Ist, a California corporation <br /> ("Contractor") and the City of Santa Ana, a charter city and municipal corporation organized and <br /> existing under the Constitution and laws of the State of California ("City"). <br /> RECITALS: <br /> <br /> A. The parties entered into Agreement A-2011-249, dated November 7, 2011, (hereinafter "said <br /> Agreement") by which Contractor has provided fountain maintenance and repair services. <br /> <br /> B. In accordance with the terms and conditions, the parties wish to amend said Agreement to <br /> include an additional fountain site for maintenance and repairs, increase compensation to pay <br /> for the additional services and provide a contingency for unanticipated repairs that may be <br /> required during the term of said Agreement. <br /> <br /> WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br /> the terms and conditions of said Agreement, except those amended in this First Amendment to <br /> Agreement, the parties agree as follows: <br /> <br /> <br /> I . Section 1, SCOPE OF SERVICES, shall be amended to include Contractor shall provide <br /> maintenance and repair services for the fountain located at the Santa Ana Regional <br /> Transportation Center (SARTC). Said SARTC maintenance shall be performed on a once a <br /> week basis, and shall comply with the Specifications for maintenance and repair of the <br /> fountains in Downtown Santa Ana and the Civic Center, set forth in said Agreement as <br /> Exhibit A. <br /> 2. Section 2, COMPENSATION, shall be amended to increase compensation by $3,300, to pay <br /> for the additional services at SARTC and an additional $6,000 contingency for unanticipated <br /> maintenance and repairs required during the term of said Agreement. The total amount to be <br /> expended shall not exceed $39,990, during the term of said Agreement. <br /> 3.
