<br /> <br /> <br /> <br /> <br /> <br /> <br /> expenses and costs relating thereto (including attorneys' fees) arising out of or in any <br /> <br /> way related to the performance of services pursuant to this Agreement. <br /> <br /> <br /> <br /> B. Except as provided in Article VI., Section 4. E. below, from and <br /> <br /> after the Effective Date, the Authority shall defend, indemnify and hold harmless the <br /> <br /> County and each of the County's officers, employees, agents and representatives with <br /> <br /> respect to any loss, damage, injury, claim, demand, litigation or liability and all expenses <br /> <br /> and costs relating thereto (including attorneys' fees) arising out of or in any way related <br /> <br /> to any Fire Department contract or agreement assumed by or otherwise transferred to <br /> the Authority. <br /> <br /> <br /> <br /> C. Except as provided in Article VI., Section 4. E. below, from and <br /> <br /> after the Effective Date, the Authority shall defend, indemnify and hold harmless the <br /> <br /> County and each of the County's officers, employees, agents and representatives with <br /> <br /> respect to any loss, damage, injury, claim, demand, litigation or liability and all expenses <br /> <br /> and costs relating thereto (including attorneys' fees) arising out of or in any way related <br /> <br /> to any Fire Department asset to be transferred to the Authority, including but not limited <br /> <br /> to real property, personal property, equipment and apparatus. <br /> <br /> <br /> D. From and after the Effective Date, the Authority shall maintain <br /> <br /> during the term of this Agreement, workers' compensation insurance as required by law <br /> <br /> and, in addition, general comprehensive liability insurance in the minimum limit of <br /> <br /> <br /> <br /> <br /> 4509-08 <br /> 110179 v3 28 <br /> 9/27/99 <br /> 60C-35 <br />
