A-2011-221 <br />ORK W P- " <br />J / 1 l 7_01 <br />THIRD AMENDMENT TO <br />AGREEMENT BETWEEN THE CITY OF SANTA ANA <br />AND OLIVE CREST FOR THE USE OF <br />HOMELESSNESS PREVENTION AND <br />RAPID REHOUSING GRANT FUNDS <br />THIS THIRD AMENDMENT TO AGREEMENT is entered into on the 161h day of <br />August 2011, by and between Olive Crest, a California non-profit corporation ("Subrecipient") <br />and the City of Santa Ana, a charter city and municipal corporation organized and existing under <br />the Constitution and laws of the State of California ("City"). <br />RECITALS: <br />A. The parties entered into that certain Agreement Between the City of Santa Ana and Olive <br />Crest for Use of Homelessness Prevention and Rapid Rehousing Grant Funds (Program Year <br />2009-10), dated September 30, 2009, (hereinafter "said Agreement") by which Subrecipient <br />has been providing support to the homeless youth or those who are at risk for homelessness. <br />B. On � 2011, said Agreement was amended to decrease services and funding for this <br />n expenditure rates and projections as to whether each grantee could <br />Subrecipient based o e p p � <br />meet the HPRP statutory requirement that grantees expend 60% of its award funds within 2 <br />years of the date that the U.S. Department of Housing and Urban Development ("HUD") <br />signed the grant agreement. <br />C. The City's HPRP program requires that grantee's expend 100% of its award funds by June <br />20, 2012. HUD may recapture and reallocate unused HPRP funds if grantee cannot meet this <br />requirement. <br />D. Based upon current expenditure rates and projections as to whether each grantee can meet <br />this requirement, the parties hereto have agreed to this amendment to decrease services and <br />Homelessness Prevention and Rapid Re -Housing grant funds. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br />the terms and conditions of said Agreement, except those amended in this Third Amendment to <br />Agreement, the parties agree as follows: <br />1. The Budget that is referenced in the Agreement as "Exhibit B" shall be amended and <br />replaced with a revised Exhibit B due to this Amendment. <br />2. Section VI, A. "Agreement Amount" shall be reduced by $70,000, due to the reduced <br />services. $15,000 will be returned from the Homelessness Prevention grant and $55,000 will <br />be returned from the Rapid Re -Housing grant. <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />
