2005, the City Council of the City of Santa Ana ( "Council "), after providing notice as required <br />by law, held a public hearing to consider the- OwnerCoastal Rim's application for the 2005 <br />Agreement, which the Council approved by adopting Ordinance No NS -2680 on April 18, 2005. <br />The Owner has submitted a new and modified site plan review package to the City amending the <br />previously approved plan On January 23 2012, the Planning Commission of the City, after duly <br />giving notice pursuant to Government Code sections 65090 and 65091 held a public hearing to <br />consider the Owner's application for this Ag eement The Planning Commission recommended <br />to the Council that it execute this Agreement. On [insert date]., the Council, after providing <br />notice as required by law, duly held a public hearing to consider the Owner's application for this <br />Aareement. <br />1.6 Council Findings. The Council finds that this Agrcement and its <br />�utposes is are consistent with Government Code Sections 65864 through 65869.5, and with the <br />objectives, policies general land uses, and prod am specified in the General Plan, applicable <br />Specific Plan(s) as well as all other applicable ordinances, plans, policies and regulations of the <br />City. Among other things, this Agreement will reduce uncertainty in planning for and securing <br />ensure attainment of the maximum effective utilization of resources within the CLtyat the least <br />cost to its citizens, expand the availability of high— quality, affordable housing stock to the City's <br />citizens contribute to the economic stability and revitalization of the community, enhance the <br />City's property tax revenues, and otherwise achieve the goals and purposes for which <br />Government Code Sections 65864 through 65869.5 were enacted. <br />1.7 City Ordinance. On Aia418,2005 (insert date] the Council adopted <br />Ordinance No. NS- approving this Amended Agreement. The ordinance becomes <br />effective thirty (30) days thereafter. <br />2. DEFINITIONS. In the Agreement, unless the context otherwise requires: <br />2.1 "Final Design" means the final design documents for work of public art, <br />which is set forth in greater detail in paragraph Section 5.8 of this Agreement. <br />2.2 "Property Owner" or "Owner" means Coastal Rim � ^per ies; W., a <br />Califemia Cerperatio"nd eneve Comm collectively VDC at the Met, LLC, a California <br />Limited Liability Company and its successors or assigns who or which may acquire Owner's <br />equitable and legal interest in the Property, being the person, persons, or entity having a legal or <br />equitable interest in the Property-,and-includes riu^ °min <br />interest. <br />2.3 "Property" is the real property described in Exhibit A and referred to in <br />Exhibit B. <br />14 "Project" is the development of the Property as generally set forth in <br />Section l .1(4) of this Agreement, Environmental Review No. 2002 215 , Tentative <br />Tract Map No, 2004 -05 (County Map N6. 16556 - ), Conditional Use Permit <br />��_Q196� <br />
