INSURANCE oN FILE <br />WORK MAY PROCEED <br />UN rL INSURtNCE EXPIRES <br />CLERK OF COU190- <br />DATFIRST AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT <br />A -2010-21"I <br />THIS FIRST AMENDMENT TO AGREEMENT, made and entered into this IS day of <br />yf bPLURd , 201 -by and between Kimley-Horn and Associates, Inc., North Carolina <br />Corporation (hereinafter "Consultant"), and THE CITY OF SANTA ANA, a charter city and <br />municipal corporation duly organized and existing under the constitution and laws of the state of <br />California (the "City"). <br />RECITALS <br />A. City and Consultant entered into Agreement -2010-215, dated November 15, 2010, <br />for a consultant having special skill and knowledge in the field of professional <br />environmental reports and services (hereinafter "said Agreement"). <br />B. In accordance with the terms and conditions of said Agreement, the Parties desire to <br />extend the term of said Agreement either through the completion of the Environmental <br />Impact Report or the expenditure of funds. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions of said Agreement, except as herein modified, the parties agree as follows: <br />1. Section 4, TERM, shall be amended to extend the term of said Agreement to terminate <br />upon the completion of the Environmental Impact Report or the expenditure of all <br />allocated funds, unless terminated earlier in accordance with Section 13 of said <br />Agreement. <br />3. Except as hereinabove modified, all terms and conditions of said Agreement shall remain <br />in full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to Agreement <br />the date and year first above written. <br />ATTEST: <br />-AI-2,6 , <br />MARIA D.
